NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #27

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It will resume on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

I believe we're allowed to comment only on Tribunal Tweets posts on Twitter (and similarly allowed organisations) as they are 'out in the world' if you like but not on happenings in the court room as it happens.

have now seen pictures of Bumbla, and i do feel a little bit sorry for her (but not completely)

How many of us would have turned down such a high paying job at her age? added to the zeal of youth and truly believing that it will enhance people's lives? of course, common sense (of which young people have nearly none, so often) should have told her to be much more careful.

ETA: i fear she's going right under the bus, though, and those who employed her will get off scott free.

Yes that's how I understand it. If TT have posted about what is happening we are allowed to comment on it here. But anyone who is observing is not allowed to report here on what is going on.

Issues with bundles reported on TT.

For anyone with knowledge, is it normal for there to be issues with bundles? It seems to come up on every ET on this issue.

I can hear the proceedings (audio isn't great) but all I have is the black screen with crossed out cameras and xx waiting in the lobby.

I read something about logging out and back in of that happened but I'm afraid of not getting back in.

Oh well, audio is better than nothing but I'd like to be able to see it and know who is talking

If Fife offer to settle and Sandie refuses, wins but is then awarded less than Fife offered, is she liable for all costs?

If the tribunal think SP's refusal to settle was unreasonable they can award Fife's costs from that point on, but not their costs prior to the settlement being refused. Note that they can award costs. They don't have to.
