NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #27

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It will resume on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

Sandie is the claimant so can choose whether to continue with the claim or not. Fife as the defendant can either choose to defend the claim or give up. In practice, its more likely that Fife will want to settle but whether Sandie accepts any offer to settle is completely up to her.

If Fife offer to settle and Sandie refuses, wins but is then awarded less than Fife offered, is she liable for all costs?

If this is the case, I suspect someone has offered to step in and cover it, should it occur.

I've understood enough from discussions on here that costs can be affected by how un/reasonable continuing the case seems, if the other side wants to settle.

I think the combination of accusations of discrimination, transphobia, hate crimes AND professional misconduct putting patients' lives in danger were such a profound attack on SP's personal and professional character that it would be unreasonable to let them off the hook.

Not to mention the grudging statement about being cleared of the allegations BUT still needing time in a re-education camp 'a facilitated reflective practice discussion'..

Could it be argued that continuation of this case is in the public interest? To find out exactly how GI has been accepted within our publicly funded services to the extent that such a ridiculous situation came to pass?
