NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #27

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It will resume on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

Caller: I’m so distressed. Women are maintaining they are fully human, and have corresponding rights. When we all know they are only support humans who must facilitate men’s desires and any sense of entitlement.

NHS Fife: There, there (as they figuratively mop brow of distressed caller). We’re doing all we can do to rectify the expectations of those witchy women who don’t know their proper place.

NB: As I imagine a scenario due to any exposure of NHS Fife management and senior bods that I’ve heard or seen.

I found a lump last month and was referred to Fife NHS Breast Clinic. Phoned to check the waiting list...15 to 18 weeks for "[my] criteria". That was if I was prepared to got to Larbert, because of the waiting list in Fife.

I paid for a private consultation and mammogram at the Spire in the end. Got the all-clear. Thank goodness - couldn't have afforded to pay for actual treatment.

I have a strong feeling this will be settled - at least between Sandie Peggie and NHS Fife. If they do settle, there needs to be a clear statement from the latter accepting full responsibility for what has happened and an acknowledgement as to what the law means in practice going forwards.

I suspect that there is many a bad tempered, hissed conversation going on in the Court this morning between NHS Fife, Upton and JR.

As do I. I'm really supposed to be doing something important that requires all my attention, but I'm failing badly as I am struggling to concentrate. I just want it to start. I'm crap at multi tasking at the best of times. I may have to abandon the important thing if the tribunal ever gets started.

Going back to Fife’s decision to not uphold the complaints.

1. Even though they have completed the disciplinary the way they have handled the suspension, the “not an investigation” investigation, the investigation and the time delays etc. will go against them for not following their own processes in a timely manner.
2. the panel found that there was insufficient evidence to support a finding of misconduct. While no formal sanctions have been imposed, the panel concluded that a facilitated reflective practice discussion would be appropriate. - This means the panel thought there was evidence, just not strong enough to find misconduct. That is still suggestive that in their opinion SP did do something wrong. The facilitated reflective practice discussion is saying she needs to improve. I would say from SPs perspective this leaves an element of doubt about her professionalism and in her shoes I would want complete exoneration.

If I were Sandie, I would take nothing less than a full page apology from NHS Fife in every newspaper in Scotland.
