NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #27

nauticant · 13/07/2025 08:26

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It will resume on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

Access to view the hearing remotely was obtainable by sending an email request to [email protected] by 5pm on Wednesday 9 July. Detailed instructions wereFri provided here:

I know very little about how these things work. If Sandie wins, and say the anonymous backer has spent 200k on funding this, do they get all their money back ?

I think the ET can award costs and damages.
Which could be pretty hefty I'd think 🤔.

I wonder if those with access are able to record the live proceedings on their computer and share/upload for all of us to see?

I'm pretty sure you're not allowed to do that!

100% not

I wonder if those with access are able to record the live proceedings on their computer and share/upload for all of us to see?

That is clear contempt of court.

No! Definitely not! This would be contempt of court!

alsoFanOfNaomi · 16/07/2025 10:33

Unless things have changed radically since I last got into an ET, @SamiSnail , recording proceedings is a criminal offence!

What I came to say:

From the Herald livestream:
From Political Editor Andrew Learmonth in Dundee:
The tribunal was supposed to start at 10 but we’re still waiting to get in. We’re thinking there might be some negotiation, some procedural stuff going on just now. Lots of speculation about what might happen. Could Dr Upton sack their KC? Could the board?

wheretoyougonow · 16/07/2025 10:33

A little off topic but on NHS Fife X account it states :
If you are experiencing despair or distress please call NHS 24 on 111.
Well - what if they are the ones causing the despair? 😂

No that isn't allowed

All eyes on the Sandie Peggie tribunal this morning except mine as it appears the employment tribunal have not granted my request for access. Quite extraordinary given my professional interest and the fact that I will be writing about the case. Open justice??

I now feel much better about my own lack of access! I am at least in good company 😊

I don't think that wouldn't be allowed by the Judge.

Jesus Christ. You’re definitely not allowed to do that.

Please don't. They need no encouragement to be a nuisance!

Waitwhat23 · 16/07/2025 10:33

I don't think that wouldn't be allowed by the Judge.

The first notice that flashes up on joining is that recording/screenshots isn't allowed either with a computer or phone. And this would be a criminal offense. Paraphrasing, not the exact words.

BezMills · 16/07/2025 10:36

This just in. The judge has asked JR to take a seat in his chambers. He didn't put out the good biscuits.

IknowTheBoswellJoke · 16/07/2025 10:36

Can we start calling it ‘The Tribuneral’ to mark Fifes impending demise?

I don't know. Might be educational for NHS Fife to be on the receiving end for a change..
