Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It will resume on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

Just so we don't end up with a thread of the most disappointed people in the world, NHS Fife could at this late stage say to Sandie Peggie "we will concede everything, we will issue whatever statements you request, we will pay all of your costs, we will pay handsome damages, and we will throw Dr Upton under the bus" and get a halt to proceedings if this was acceptable to her, at least those between them and Sandie Peggie.

Does your email with instruction contain an email address for the court/tribunal? i haven’t had an automatic acknowledgement to my email to [email protected] this morning which leads me to suspect it is no longer being used for this hearing.

And yes my junk folder has been thoroughly checked.

Sorry to bump my own post. I am getting no automatic acknowledgment from the email address in the operational note, Edinburgh ET (the email address for the first part of the hearing) have politely said nothing to do with us, if you’ve not heard then you’re not in. So is there any other email address in your correspondence, e.g. for technical issues?

Surely another adjournment will look terrible for NHS fife tho? Well TBF I reckon whatever they do now will make them look like plonkers so...🤔

I did wonder about writing to the Tribunal to suggest that they withhold 10% of places to provide to people from the start of the (resumption of the) hearing onwards who could make requests with good reasons because there would inevitably but fuck-ups.
