NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #27

nauticant · 13/07/2025 08:26

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It will resume on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

Access to view the hearing remotely was obtainable by sending an email request to [email protected] by 5pm on Wednesday 9 July. Detailed instructions wereFri provided here:

Is anyone in a room other than number 4 (number is in email title)?

IAmNotASheep · 15/07/2025 13:54

I used [email protected] for the original applicant and got the acknowledgment but nothing since. Trying hard to not keep refreshing my inbox.

Thanks. That worked . Waiting now too 🙏

I think they've tracked all of the requests from MN people and put us in room 4.

I'm in 5 but as we are not contributing can't see what difference it would make.

I was wondering if access got revoked for some reason whether that would be done room by room or everyone all at once.

Me neither. I’ve had a message back saying the email address [email protected] isn’t receiving messages. Been bounced back three times now. Any advice re another method. It could of course be a matter of lunch time I suppose

Inbox too full to receive additional messages?!

How would they know who's an MN person?

ChimpanzeeThatMonkeyNews · 15/07/2025 14:57

I have a question, and i’m a buffoon, so it could be a bloody stupid question.

I emailed them last week, and received a response shortly after, with an Operational Note attached.

That means I’m allowed in, is that right?

KittySoftPaws1 · 15/07/2025 15:00

I had a look on NHS Fife website and they said they are going ahead with the tribunal case because Sandie Peggie wants to carry on. If that's true, good on her. They've put her through so much, they need to lose in a very public way.

ickky · 15/07/2025 15:00

@ChimpanzeeThatMonkeyNews

Did the operational note instruct you to email somewhere else to get the link?

The email to request a link was

[email protected]

But you had to do it before 5pm on the 9th July.

ChimpanzeeThatMonkeyNews · 15/07/2025 15:07

Yes, it did, @ikky.Which i responded to including the details it requested in the ON.

ChimpanzeeThatMonkeyNews · 15/07/2025 15:09

I was past the deadline though, at that point.

I know this post will get lost and some posters will disagree but I am going to ask posters to remember Isla Bumba is a young woman.

She should not become Fife’s scapegoat. The Board and senior managers recruited her, they supported her actions, they did not follow their own suspension and grievance/disciplinary processes.

I don’t think she should be the scapegoat but my opinion of her will be dependent upon her testimony. If she doubles down on TWAW and therefore Upton was entitled to use female facilties and Sandie is a nasty old bigot then I may just have a scarcity of sympathy

SidewaysOtter · 15/07/2025 15:26

I'm in room 3.

With regards this statement:

If you are a journalist registered with Scottish Courts and Tribunals Service
and/or you have a UK Press Card Authority press card, you may use live, text
based forms of communication while observing a hearing, unless the Judge
directs otherwise. You must advise the Tribunal in advance that you plan to
do so and provide evidence of your credentials. Otherwise, if you wish to live
tweet any part of the proceedings you must obtain the permission of the
Tribunal in advance and , if permission is granted , it may be subject to
conditions. The Judge may direct at any time that such communication
cease if the judge considers that it is interfering with the administration of
justice.

The bold bit seems to suggest that thisonly seems to relate to tweeting, not online comments (e.g. posting here).
