Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It will resume on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

I've been accepted as an observer too. There's a document with rules for observers included in the email. It covers things like, no recording the tribunal, no interrupting, no sharing the link etc. Point 11 seems relevant to the discussion on here previously:

If you are a journalist registered with Scottish Courts and Tribunals Service
and/or you have a UK Press Card Authority press card, you may use live, text
based forms of communication while observing a hearing, unless the Judge
directs otherwise. You must advise the Tribunal in advance that you plan to
do so and provide evidence of your credentials. Otherwise, if you wish to live
tweet any part of the proceedings you must obtain the permission of the
Tribunal in advance and , if permission is granted , it may be subject to
conditions. The Judge may direct at any time that such communication
cease if the judge considers that it is interfering with the administration of
justice.

My take is that those attending in person can discuss TT as well as anyone else, they just cant add anything that TT hasnt said.

Kate Searle was clinical supervisor for Upton at the time of his complaints. His registration now shows Christopher McKenna as the responsible officer. I think that's a change and have been trying to see if there were any contemporaneous notes on these threads - not so far but I'm only up to 13. However it has reminded me that Kate Searle was included in NHS Fife's request for anonymity before the tribunal, the only witness apart from Upton included in that request, and that they subsequently asked for her to give evidence in private. Both requests were refused.

Good morning/afternoon,

Your application to view the above-named case has been successful. Information is attached that must be read prior to observing this hearing.

Although the attached direction asks for you to join 10 minutes before the start of the hearing. On this occasion, due to the large numbers expected, please ensure that you follow the direction given in the Operational Note, that being “Members of the public observing the hearing remotely must join the link 30 minutes prior to the start of the hearing. When joining, the OBSERVER option must be selected.”

You must also use the same information used when applying for access to observe this hearing, i.e. your full name and in what capacity you are joining when prompted to do so upon joining the CVP room. An example of how this looks is provided in the attached “Guidance for CVP Observers” document. Failure to use the same name provided in your application will result in you not being granted access.

Permission to observe is only given to the person or persons named in the application. You must not share the link provided with anyone else or use a link provided to someone else. The joining instructions provided here remain the same and grant access to each day that this case runs. You may be asked to identify yourself when you join the hearing.

This public access is so very important - an essential portal into seeing justice being done for women, with Sandie hitting the final hurdles now. She has been, and is, incredible.

Me neither. I’ve had a message back saying the email address [email protected] isn’t receiving messages. Been bounced back three times now. Any advice re another method. It could of course be a matter of lunch time I suppose

I used [email protected] for the original applicant and got the acknowledgment but nothing since. Trying hard to not keep refreshing my inbox.
