NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #6

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 January 2025 and is expected to continue for 2 weeks. The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton started giving evidence on 6 February.

NC still wants the searches done, says it's not hyperbolic to call it defiance, but even if so, it's still extremely negligent; and wonders whether Mr Watson will know who else got the document

That sounds really dodgy, what do they do if there's an inquiry? At least three times in the last few years (including for the COVID inquiry) we've been asked for everyone in the organisation to search their emails with regard to the subject of the inquiry, and either submit them if certify that we have nothing relevant - how could they comply with that if they've completely deleted stuff??

It probably is actually - basically what happened was the everyone suddenly found that their inboxes were nearly full or actually full and unable to receive new emails. Result was individuals deleting lots of stuff randomly

Teams meetings were always documented in the CS - if something wasn't written down/recorded it in effect didn't happen.

NC - I want to stress our application for an order for specific searches.

the respondent's approach to compliance with order has if not been deliberate been extraordinarily [? some fucker boiling a kettle here ]

Please ask 1st respondent's IT dept to conduct search of email using keywords

Judge there could be thousands

NC - yes, searches are likely to recover that, manual review will need to be done

Judge to JR - can the IT department do this?

JR - will ask. If you go down that route it's like the tribunal will have to be adjourned

My former employer did backups every night, so even if deleted they may exist there.
