NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #6

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 January 2025 and is expected to continue for 2 weeks. The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton started giving evidence on 6 February.

Unbelievable - JR is trying to pretend that the documents not disclosed are not relevant even though Judge Tinder (?) made an order specifically requested all docs disclosed.

I think it's Judge Timmion.

This again comes back to what NC has said - these are extremely serious accusations, so serious that SP had to be suspended, and yet at the same time we're being told not serious enough to warrant a careful paper trail or investigation, just a few quick chats, because they're all too busy doing important things.

Have I understood this correctly? JR is saying that ED could not be part of the investigation because SP had spoken with her about concerns. But also said that ED took Dr U's statement. How does that follow? I'm confused.

JR - second category - there's a MS Teams invite, no note of discussion.

Judge - simply an example? We really are going back to the terms of the order.

JR - confirming that Esther Davidson's role was only to collect 2nd respondent's statement and she didn't conduct investigation herself

Judge - what is collecting? Receive a statement? Anything beyond being a postbox? What did the postman say, what did the postman do?

Judge - is Fife's position that Davidson undertook an investigation?
JR - I wouldn't call it that but will take instructions.

Is that legalese for 'I don't know WTF is going on, and if I find out that I've been set up, there'll be big trouble!'?

Crikey this escalated fast didn't it?

Unfortunately, in my NHS trust (elsewhere in Scotland) cost cutting has led to an unannounced and arbitrary reduction in size of outlook email capacity a few months back - with associated bulk deleting of old emails.

I would be concerned that something similar might mean that the missing documents and email chains could actually be unrecoverable... And that there is plausible deniability about why the emails were not provided in initial disclosure searches.

Although actually now I think about it, doctors were mysteriously spared in the storage capacity cut.

That sounds really dodgy, what do they do if there's an inquiry? At least three times in the last few years (including for the COVID inquiry) we've been asked for everyone in the organisation to search their emails with regard to the subject of the inquiry, and either submit them if certify that we have nothing relevant - how could they comply with that if they've completely deleted stuff??

Never attribute to malevolence what can be explained by incompetence? And yet I assume there is a disclosure officer specifically tasked with compliance with such court orders....
