NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #6

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 January 2025 and is expected to continue for 2 weeks. The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton started giving evidence on 6 February.

JR is red faced and getting crosser by the minute

She's livid. J isn't having any of it.

JR - 'it's said that there's a mystery, mention of Esther then investigators were different people - I can explain that'

JR - Davidson's only involvement was to collect a statement from Beth.
Judge - is Fife's position that Davidson undertook an investigation?
JR - I wouldn't call it that but will take instructions.

'Ann Hamilton had a verbal discussion with Esther, aren't any docs, in Feb 2024, during discussion, she will say she realised Esther had been involved in incident, because Esther told her claimant had approached her with concerns, when Anne Hamilton realised that in that conversation, she todl Esther she could not be invovled in investigation. That's why there was a change'.

JR: Anne hamilton decided that any IX should not be done by Esther
AH is coming to the tribunal to give evidence

AH realised that Esther was involved in the incident (so told her she couldn’t be involved in IX) - this discussion was undocumented

'The 1st respondents deal with things by talking to each other because they're in a busy A&E environment'

Russell currently explaining why there was a lack of documentation about the investigation. It's the best she can do but it's a bad thing to admit.

Whereas the 2nd respondent is in a busy A&E environment making copious notes about colleagues

Unbelievable - JR is trying to pretend that the documents not disclosed are not relevant even though Judge Tinder (?) made an order specifically requested all docs disclosed.

OK so we're going with 'nothing to see here, Esther wasn't involved in the investigation'

and discussing the case with at least one other person...
and then presumably being involved in a discussion that she shouldn't be involved...
Which was conveniently not documented...

she sounds cross and argumentative which will not be going down well.

‘They’re in a busy A&E department’ - what the A&E department where a male doctor was bursting into tears about micro-aggressions and not being looked in the eye, therefore needing to make a complaint about ‘hate’?
