NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #4

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 January 2025 and is expected to continue for 2 weeks.

It will be relevant later when they talk about SP not caring for patients and refusing to carry out standard nursing tasks. Part of the harrassment claim is that SP tried to delegate nursing tasks to Dr U

DU now outlining that on arrival at this dept he asked his supervisor if it was ok for him to use the female changing rooms and toilets as this is what he had done elsewhere. DU states he was aware that some people 'have issues' with tran people.

He admits he used the female bathrooms prior to this conversation and prior to getting any guidance on this

Ah I see. For goodness sake. Am HCP so aware of nurses' roles but couldn't understand relevance of this line of questioning. Still doesn't have anything to do with whether or not he should use the women's changing room (no) or whether SP was right to complain (yes)

The idea that Dr U thought he'd be outed as trans if publicly named is so laughable. Does he actually, seriously, for even one moment, think women think he's female?

In my trust there is still a sign off and competency process.

Probably, but even if SP was the worst nurse in the world (which obviously she isn't) SP and all females still are entitled to female only spaces (to get changed in) without men FGS.

This sounds like trying to discredit someone's character in a way rape victims were once discredited for wearing revealing clothing etc.

Exactly. I know it's her job to defend her client but the difference in tone is shocking. I've seen enough of these tribunals now to know that's not usual. NC is the same with everyone

Not true. Lots of staff saying they stand with SP. They just don't want to be sacked.

And in my book respecting someone means telling them the truth.

So starts work 02/08/23 and noted SP standing outside the CR.

Dr U. Noted SP leaving the cubicle. Thought it was strange if it happened again would escalate it to somebody! Escalate that a woman left a room when a man is getting undressed!
