NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #4

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 January 2025 and is expected to continue for 2 weeks.

Access to view the hearing remotely can be obtained by sending an email request to [email protected] headed Public Access Request (Peggie v Fife Health Board) 4104864/2024 and requesting access.

Dr U is saying that from the very first time he encountered SP in the changing room he had kept a note that she was standing outside thinking this was "unusual" and that she might be uncomfortable. He felt uncomfortable but he did not consider it inherently rude or didn't want to attach any negative meaning to this. But he kept a note and thought if it happened again he would "escalate" this

What about patients? I know my relative, suffering from dementia, would not have the capacity to deceive. If patients mix sexed him what then?

I don't know what grates most, JR's sympathetic voice or the nasty one we've seen the last few days. Both sound so false.

It's crossed my mind to wonder if JR is aware of SP's very recent bereavement. I sincerely hope she isn't, because it would put her aggressive questioning of SP in an even worse light.

I've just seen the link about Sandie's dad sadly passing away at the beginning of January. That was his last Christmas. I imagine he might have been poorly, and everyone in the family was trying their best to keep it together and make it a nice time. I've no words right now about that despicable line of questioning from JR.

I know a number of trans-iding young men like him, and I recognise this.

It is all so easy for this young man, isn’t it? Feted and made exceptions for by all the enablers around him. A row of supporters at his back. And the fact that he is at such ease in this situation - with lawyers, professionals - as a result of his middle-class privileged education and background.

He sounds so very reasonable etc.

And then he casually says how he was making all these notes about her on his phone...

We had a thread along these lines a few months ago - a TIM kicking off because women wouldn't use the same toilet as him. There were posters saying this was far fetched, IIRC.

The idea that Dr U thought he'd be outed as trans if publicly named is so laughable. Does he actually, seriously, for even one moment, think women think he's female?

I find the level of gaslighting quite difficult to deal with as someone with personal experience of this type of abuse. Of course women see a man.

Exactly. I know it's her job to defend her client but the difference in tone is shocking. I've seen enough of these tribunals now to know that's not usual. NC is the same with everyone

For the tone thing, I try to keep it the same for everyone but if a witness is being particularly difficult (refusing to answer a question, becoming belligerent etc.,) then I will take on a harsher voice. Sometimes clients will ask that you give a witness a hard time and grill them, but ultimately how you decide to go about questioning witnesses is entirely up to counsel. In criminal law there's definitely an element of being very harsh with liars and unsympathetic witnesses, but it tends to be less extreme in the civil courts.
