NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board - thread #2

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 January 2025 and is expected to continue for 2 weeks.

I've come to the conclusion that according to NHS Fife SP could only ever have done the right thing if she had prostrated herself on the floor at the alter of transpeople.

Again, I don't think that haranging a dejected witness over compelled speech, when it's clear that she's justified in not following compelled speech in the circumstances in question, is that great an approach.

It's very pre-2020.

SP I tried to gender Beth as he wanted to be gendered unfortunately it doesn't come easily to me as I know he's a man.

JR accuses SP for not gendering Dr Upton correctly at all during proceedings

SP has repeatedly used she during this. A lot is times she uses she and he in the same sentence.

SP losing her way. She just has to say the truth: if she did not use the correct pronoun when confronting BU she is agreeing he should be there, as it would be suggesting he is a she, which he is not

I'm screaming into the void here with JR's 'misgendering' line of questioning.

It's been made clear that this case rests on Upton being male and SP calling him so in court is not the same as at work, if she had done that.

You'd think a lawyer might have come across concepts such as indecent exposure and voyeurism, wouldn't you?

Clearly Dr Upton hasn't brought along the brightest and best.

And even then, whilst carefully endeavouring to refer to this male as ‘she’, JR has forgotten she cannot admit that she knows he is male and referred to Upton as ‘he’.
