NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board - thread #2

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 January 2025 and is expected to continue for 2 weeks.

From here on trib tweets. It was in relation to how Uptons' conduct could be classed as sexual when no sexual act took place. Naomi then interjected to say that part of the claim didn't require any sexual act. So Russell had not understood the relevant piece of legislation.

I think JR is currently trying to say SP mentioning a man in a woman's prison was basically accusing Beth of being a rapist, because JRs really going on about a male rapist in a woman's prison.

Reading the excellent comments here, and dipping into Tribunal Tweets, I’m forced to conclude (not for the first time) that the world has gone stark, staring mad.

I know JR is doing her job but how she sleeps at night having to put forward this feeble and profoundly offensive stuff I just do not know.

Interesting JR is calling Isla Bryson ‘a male’ repeatedly. Perhaps just a reappearance of that special rapist gender thing though, as she did herself say earlier how profoundly offensive it would be to call a TW a man.

I think JR is trying to make the point that Sandie bullying even if she was speaking in a calm manner, but at the same time Dr Upton couldn't have been intimidating as he was calm and didn't touch her!

Peggie was wrong for being assertive in the changing room and also wrong for not being assertive enough in seeking a solution to the problem with management.

I am watching this case with interest. In my work we do not have changing rooms, but we do have male and female toilets. Under our HR policies it is stated that anyone can use a toilet they are most comfortable with, so a man can in effect use the ladies toilet and a couple do. Moreover elsewhere TG allies are encouraged to challenge anyone who disagrees with this. I am hoping that this case establishes a clear precedent that when a toilet or changing room says female it means clear biological female.

INAL but isn't SP being asked an awful lot of questions about other people's feelings, actions and motivations? How can she know them?

Also JR appears (to my uneducated ear) to be asking lots of leading questions.

JR - isn't it more likely that DU brought complaint because very upset
SP - hard to know motivations
JR - part of victimisation is retaliatory

By jove, she'd got it (but not in the way that she intended). Dr gets upset with nurse so he gets her suspended and sacked

The insanity of this is that Peggie's complaint is actually about the NHS, and the government could make themselves aware of this case, and the Darlington one, and realise that they could save a great deal of hassle and disruption by not permitting male people into women's changing rooms. To do otherwise is simply inviting conflict.
