NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board - thread #2

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 January 2025 and is expected to continue for 2 weeks.

I think the midnight point is about you wouldn’t challenge a man out walking at midnight like you would at midday.

For SP midnight was midday for her because she was working.

This is the second time that Russell has asked Peggie to give an explanation of the law.

I'm vacillating between being so incredulous that this is even happening, to sheer rage.

So, to summarise. An experienced female nurse, with an apparently unblemished record, patiently waited outside the CR on 2 previous occasions when a junior doctor, Beth, was in there. As did others. The nurse asked for advice/guidance and the hospital ignored her. On the third occasion, when dealing with a heavy period, she asked Beth for a bit of empathy. Beth ignored the obvious distress and took offence, wrote an essay and accused the poor nurse of bullying.

This is absolutely chilling.

God, it really doesn't bode well that the defence's lead counsel hasn't understood the claimants claim

IANAL but having read plenty crime novels even I know that guilt by association is a very weak case.

Her language to BU was only offensive because BU is delusional and easily offended. She stated the truth, which hurt. Tough.

SP The objection was the NHS allowing Beth to come into a female area.

Cross-examining the claimant about their statement of claim and in terms of its legal substance isn't as clever as Russell thinks it is.

Oh I think the "rejection" actually meant "did you think Dr Upton was being bloody-minded when not leaving the room when asked to"? Perhaps.

Can those watching confirm whether or not there are any female members of the panel (though obviously they could identify as something else)?
