My exh is planning to take me to court for having a Facebook name using his surname. I live in France and I do not have the right to use his surname since the divorce and never have. Been divorced for nearly 9 years.

But, it's not my page. It belongs to an American lady which a cursory glance shows. It's clearly not mine. Not entirely sure how to tackle this.

Please can someone let me know what they would do. I am secretly delighted that he googles my old married name after all these years.

I wouldn't do anything. If it's clearly not you then you have nothing to worry about and he can't do anything about it.

My first reaction would be let him! Presumably you can just reiterate this is NOT YOUR PROBLEM.
However you migut want to take advice from more sensible people.

Email his solicitor and say you can confirm that the page is not attached it anyway to you.

I would let him waste his money on solicitors, he's obviously a stupid git. There is nothing you can do as far as I can see.

I wouldn't do anything, if he takes you to court ( which I presume he will have to pay for) and it is proven it is not you he is going to be out of pocket and also look like a complete bellend. Just ignore.

Because he wrote and told me about 6 months ago. Telling me to warn my lawyer. He has a history of self presenting in court. He is a vexatious litigant - with a history of loosing. My lawyer loves winding him up and letting him loose.

As an aside, why could you not use his surname? Surely you can have whatever name you want?

I'd gather as much evidence as I could such as printing out some pages from this woman's Facebook page especially anything suggesting she lives in the USA but other than that I would react.

Even if it was you, what's he taking you to court for anyway? You can use whatever name you like can't you?

NOT in France. Your surname belongs to your husband. You can keep the use of it for your marriage. You can request to keep it at divorce but the man can refuse. It'd work the other way round of the man took the woman's name.

Let him at it. If it gets to court it'll be thrown out and he'll be liable for costs, presumably. He sounds unhinged.

I can't even begin to think how it is illegal to use whatever name you want as your Facebook name. I would just let him get on with it. It will be to his cost when he finds out it has no link to you at all.

Wait for him to spend money on Solicitors and if he does issue proceedings then contact his solicitor saying you won't be attending court as it is nonsense.
If he persists or doesn't instruct solicitors and he still issues proceedings just send irrefutable (ie paper) proof that it is not you to the court and explain in the circumstances and that you are not attending, well in advance of any arranged hearing.
Would he be issuing proceedings in a UK Court.
Personally I think it is a lot of hot air, but you know him best and know what he is capable of.

He is pretty mad. He is NC with his whole family his choice and theirs. An alcoholic albeit a day time functioning one. And definitely narcissistic. I thought he had some kind of MH issues but when I read Why Does He Do That, I came to the conclusion he is just a really nasty person.

Court would be in France I presume. Unless he's planning to take Facebook on too. Perhaps I should encourage that! Mmmm any ideas?
