NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #45

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence had been intended to be 28 July with 2 days of submissions from counsel meaning that the hearing was to have ended on 30 July. However, it became apparent as the hearing progressed that this schedule wouldn't be followed. (Considerable understatement.)

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

I get that NC is trying to salvage credibility for SP by discrediting the witness. I think though that the damage has been done. I get that some of you say that this doesn't detract from the right to SSS. Nevertheless, this is a battle for public opinion and that is crucial if you are going to turn this juggernaut around.
I can't fathom someone making a joke about the victims of the Pakistan floods. Ffs really. Would we be ok having a laugh about the Southport murders. It is just callous.

I think NC is making a very strong argument here. If anyone was to do a trawl through the last seven years of our personal private chatting history things would be found that don’t paint us in a good light.

The fact that the trawl revealed one incident where SP shared jokes that used racist language over seven years is I think not evidence of entrenched racism.

LN laughed at her comment ‘hoping it didn’t make her sound like a racist’. Could be read many different ways but one is that SP doesn’t think of herself as racist for repeating these jokes. She didn’t draft them.

Equally LN doesn’t think she is transphobic for joking about drag queens being thought of as women or for conflating drag with gay.

Nobody is pure and I’m sure we would all fail that test and probably for very different reasons.

but if that’s all they’ve got on SP which purports to position her as an all out bigot they are coming away empty handed.

Dr Upton really has caused utter carnage. Can any of these nurses go back to work after this tribunal? What was clearly already a toxic environment has just become far far worse.
