NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #45

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence had been intended to be 28 July with 2 days of submissions from counsel meaning that the hearing was to have ended on 30 July. However, it became apparent as the hearing progressed that this schedule wouldn't be followed. (Considerable understatement.)

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

I suppose there does need to be SOME precedent for women with unpalatable views being able to take legal action in this area.

Otherwise all the women banged up in HMP Corton Vale for heinous crimes may as well fling open their cell doors right now and invite the Isla Brysons of the world to sally on in.

She might have exposed Sandie for racist jokes, but this has seriously backfired on her.

I have to remember Lindsay is a witness for Fife. Fife chose to put her up.

Why oh why oh why?

Today's line of questioning reminds me of how the victim at a rapist's trial is always subjected to vile cross-questioning by the defending barrister in a attempt to besmirch their character. I seem to remember that victims used to have their phone records trawled through in an attempt to find anything that could possibly show the them in a less than saintly way. It put many victims off taking their attackers to court and I do worry that this case may put women off fighting for single sex rights.

Ms Cunningham said Ms Nicoll is "hostile" towards Ms Peggie and has it "in for her".
Ms Nicoll said she absolutely does not have it in for Ms Peggie. She said anyone who knows her would know that she finds it a "complete nightmare" to be present at the tribunal but she said she feels very strongly about it and felt she needed to do it.

Ms Nicoll said she is not transphobic. Drag queens are people who entertain, she says.

She said: "The joys of having gay sons. They better not be psyching me up to tell me they dress up in drag. There's only so much I can take."
She posted a sad face after that.
Ms Nicoll said she was making a joke.

We hear about a message that Ms Nicoll said referring to Ms Peggie as a "f", adding that it was people like Ms Peggie who started wars.
Ms Nicoll said she dislikes what Ms Peggie stands for.
Ms Cunningham said she has "made it completely clear" that she dislikes Ms Peggie and has expressed willingness to make a statement about Ms Peggie's character.
Ms Nicoll said "she should be struck off" when discussing Ms Peggie.
Ms Cunningham said: "So, this is an attempt to end Sandie's career, isn't it?"
Ms Nicoll said no, adding it was important that people were able to understand Ms Peggie's character.
She accuses Ms Peggie of "bigotry" and "racism" and said she did not think there was a place for those views in "nursing".

This is kinda a hilarious backfire how could LN this one message out of 7 years was going to cook Sandie and at the same time not considered her own messages 😂

Because there is simply no member of staff they are not willing to hang out to dry in the interest of men accessing the women's bogs.

Lindsay is simply the latest in a long line of sacrificial goats over the past two weeks.
