NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #45

1000 replies

nauticant · 28/07/2025 12:33

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence had been intended to be 28 July with 2 days of submissions from counsel meaning that the hearing was to have ended on 30 July. However, it became apparent as the hearing progressed that this schedule wouldn't be followed. (Considerable understatement.)

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

Access to view the hearing remotely was obtainable by sending an email request to [email protected] by 5pm on Wednesday 9 July. Detailed instructions were provided here:

Wow, Fife are really building up the investigations they'll have to do now.

One into Upton for tampering with his evidence

Another into multiple nurses for the inappropriate group chat

chilling19 · 28/07/2025 15:56

Ooh, it there more!!!

Firealarms · 28/07/2025 15:56

LN No. I have laughed and perhaps enabled and encouraged her to become.. you know.. enabled her to make these types of jokes. I wish I had remonstrated w he

^ doesn’t this sounds like she tried to trap SP? Encouraging her to say things to Gather evidence to use against her?

ickky · 28/07/2025 15:56

Definitely a trap coming

GreenFriedTomato · 28/07/2025 15:56

Not fair to judge me as unprofessional based on one message...

Fair for sandie though.

Oh NC has something worse about LM...

AMillionMugsNoTeabags · 28/07/2025 15:56

Oh my goodness. Is there more?

Shortshriftandlethal · 28/07/2025 15:56

So these type of racist/prejudiced exchanges are common and the staff generally go along with them, even if not overtly approving.........but DU is a member of the sacred caste and his dignity is of far more import than that of any other.

IDasIX · 28/07/2025 15:56

I am GC. I support SSS wholeheartedly. NHSFife have been an utter shambles.

I said on these threads back in Feb that it sounded like everyone involved, including SP, were utterly awful. If I worked with her, I’d be going to lengths to avoid her.

It was obvious back then that she was likely to hold and have expressed some really unpleasant views, and it was naive to be putting her on a pedestal as a sainted nurse.

I still hope she wins her case.

MarieDeGournay · 28/07/2025 15:57

NC [new doc] Look under the inserted pseudname "eva Baird". A patients name was mentioned in full by you
LN Yes, and that was unprofessional, and a breach of regualtion
NC Also the patients complaints?
Yes
NC So from 6000 page chat, cld u say u have no respect for yr pat's

LadyBracknellsHandbagg · 28/07/2025 15:57

Boiledbeetle · 28/07/2025 15:57

murasaki · 28/07/2025 15:58

Oh dear, LN. Not so squeaky clean now, are we.

MarieDeGournay · 28/07/2025 15:58

privacy? I would say is disappointing and unprofessional. Can u repeat the Q? NC [repeats Q re fairness from 6000 pages]
LN If I was a patient I cld be seen as s'one who didnt respect their patients
NC Is that the wordt thing that cld be found against u from this chat?

BraveFacesEveryone · 28/07/2025 15:58

On a side note, from The Scotsman
‘Ms Peggie’s lawyer Naomi Cunningham says this group chat had been going for seven years and there were 2,600 pages of messages for the legal team to look at.’

I imagine JR was counting all of these this morning, rather than the 24 pages actually submitted to the bundle?

chilling19 · 28/07/2025 15:58

Cue tears

Shortshriftandlethal · 28/07/2025 15:58

NC: What's sauce for the goose must surely be sauce for the gander?

lcakethereforeIam · 28/07/2025 15:58

Lindsey has a gay son. I'd bet he's a 'be kinder'. I bet mum's been schooled by her son.

DrBlackbird · 28/07/2025 15:58

MarieDeGournay · 28/07/2025 15:31

NC [repeats Q]
LN It dep on the indiv women. I persoanlly wld be happy to have got changed in the CR
NC Do u accept invasion of privacy of a'one who does reject
LN If thats how they feel, its how they feel. But I dont have a problem w it

The 'well I don't mind so it's OK' defence..

How many posters have we seen here on FWR threads say this? I’m a good person. I wouldn’t mind so if you mind, you’re a bad person.

Plus… She doesnt want to lose our friendship. Well I’d be guessing that she might not mind now. Friends like these and all that.

Jitrenka · 28/07/2025 15:58

NC on it now!!

Chariothorses · 28/07/2025 15:59

from herald
3:57pm
Ms Cunningham asks if it is fair to develop this view based on a single extract.
Ms Nicoll said: "Certainly if I was a patient I would certainly view me as someone who didn't respect their patients."
She said she has no idea whether this would be the worst thing found against her in the group chat.
3:55pm
Ms Cunningham asks whether discussing patient details would be a breach of "regulatory obligations".
Yes it would, Ms Nicoll said.
We now hear that Ms Nicoll mentioned a patients name in full in the group chat.
"That was unprofessional of me," she said.
She also shared details of the patient's complaints.
Ms Cunningham said: "If we look at that single message from that 2,600 odd page group chat that it would be able to form a view of you as a nurse with no respect for patient privacy?"
Ms Nicoll said it was "disappointing that I've done that and it is unprofessional".

TheKeatingFive · 28/07/2025 15:59

Is this NC's finest hour?

murasaki · 28/07/2025 15:59

I wonder what else she's said in the chat...

Cismyfatarse · 28/07/2025 15:59

I have a gay son. I was upset when he told us at age 12, but not surprised. I anticipated a huge level of homophobia and social struggles that never arose, thankfully. He is amazing, powerful and very sure of himself - thank goodness. But my experience, as a straight person, of homophobia is my own friends - from another generation who were called terrible names, clause 28, no marriage etc.
