NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #45

nauticant · 28/07/2025 12:33

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence had been intended to be 28 July with 2 days of submissions from counsel meaning that the hearing was to have ended on 30 July. However, it became apparent as the hearing progressed that this schedule wouldn't be followed. (Considerable understatement.)

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

Access to view the hearing remotely was obtainable by sending an email request to [email protected] by 5pm on Wednesday 9 July. Detailed instructions were provided here:

So it was a sarcastic laugh.

I think LN intended all along to be a witness, pretended to be friends with SP and lurked in the group chat looking for evidence. And shut down anything that could have helped Sandie.

But didn’t shut down the racism, and laughed at it instead.

ickky · 28/07/2025 15:53

I sense a trap incoming.

chilling19 · 28/07/2025 15:53

I would live in fear of NC’s ‘would you turn to page …’

I think LN is currently wishing it was a vanishing laugh

LN Yes, I was shocked [by them?]
NC [reads res orry if u think I'm racist] The laughter emoji is you
Yes. A shocked wld be a better response. I agreed it made her sound like a racist
NC A laughing reaction to her post. U told us u were thoroughly shocked at the
time

[Wrong choice of emoji??]
U didnt remonstrate, leave the group or say anything.
LN No. I have laughed and perhaps enabled and encouraged her to become.. you know.. enabled her to make these types of jokes. I wish I had remonstrated w he

If only you had Lynsay, if only you had. But you didn’t, you laughed right along with it. What a hypocrite.

Sad times.

GreenFriedTomato · 28/07/2025 15:53

I've enabled her, I've encouraged her, should have spoken sooner.

Oh and bam, Lindsay has shared patient details in the group chat

Hahahaaaa fucking ha!

Not so holier than though now

AMillionMugsNoTeabags · 28/07/2025 15:54

Yeah, I've known an actual lesbian mother to say she hopes her daughter doesn't grow up gay. Which sounds terrible if you don't know it was in the context of a conversation about how tiny the lesbian dating pool is and how difficult it can be to find a partner.

This is rancid stuff. Go after the claimant if you like, but her family should be out of bounds.

Someone in my family was very very upset when her daughter came out. She might have sought reassurance and talked things through with friends and colleagues.

Not because she didn't love her, not because she didn't support her but because she was so worried for how society/other people/the world may treat her, and also because she also assumed it may mean not being a grandparent. She was definitely worried that older generations of the family may not be kind or welcoming.

All unfounded. Their wedding was a very happy occasion, no one has been expressed anything other than love and welcome and their DC are the most loved grandchildren.

You can't judge anything on a snapshot conversation.

BamsWereAtIt · 28/07/2025 15:50

FAFO, Lindsey

Writ large. Did she really think she was going to get away unscathed?

GreenFriedTomato · 28/07/2025 15:54

,😂😂😂😂😂

Oh dear...looks like LM is heading for a NMC fitness to practice hearing.

Boiledbeetle · 28/07/2025 15:54

Ooh LN mentioned patient name in full.

Oh dear LN.

And details as well says Naomi!

😱

MarieDeGournay · 28/07/2025 15:54

NC The more imp point is u laughed along as the easy thing to do. An informal gp, thought to be in private, jokes and shock.
LN None of us laughed at her joke. She'd say this during convo, follow it up verbally w "this doesnt make me a racist"
NC Can we equally conclude yr a racist?
LN I didnt laugh at the joke but later. I've encouraged her and shld have spoken up earlier
NC Yr reg says about pat confidentiality
Yes
NC So speaking about patients wld break their rules?
LN Yes

tribunalObserver · 28/07/2025 15:54

Lovely trap from NC there.

ickky · 28/07/2025 15:55

I think NHSF is going to have to open investigations into all the nurses.

LadyBracknellsHandbagg · 28/07/2025 15:55

NC has something else doesn’t she, something worse??!

No. He's entitled to his opinions. If I thought he was making a poor decision I would tell him but he's free to like or dislike people as he wishes.

The hypocrisy is white people being forced to do this stasi performance on each other we are witnessing here.

Diversity is our strength.

Absolutely not when it comes to racist comments at work especially when it likely affects colleagues' prospects, i.e. HR.

They must treat each person on their own merits. Anything else is racism, it's illegal accordingly to EQ2010, it's not "entitled to their opinion".

You are complicit in racism and all you are doing is complaining about hypocrisy, i.e. that you aren't allowed to be racist too.

Being Gay/Lesbian is a harder life, it just is. I say that as one.

Given the choice would I want my child to be? No - purely from that POV. That doesn't mean obviously I'd be disappointed if they were.

NebulousSupportPostcard · 28/07/2025 15:56

Sad times for Lindsey.

katmarie · 28/07/2025 15:56

Damn. That bag full of explosive devices @BezMills reckoned NC had has absolutely gone off now...

Excellent use of silence by NC in this questioning also.
