NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #42

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

I said upthread that if DrU had presented them as 'Something distressing happened to me in the CR, and this is how I wrote it up later', that would be OK.

His problem is that he said they were contemporaneous notes, and not only do they not read as such, they read like an essay, but JB cast serious doubts on DU's claims about his notes being contemporaneous.

He's been caught embroidering the truth at best, making stuff up at worst, and all because he didn't just say' This is how I wrote it up later'.

There is also the question of the data being manipulated with the screenshot date and time being covered by a replacement which did not quite match what the original format would have been. That goes far beyond a question of syntax, as it were.

MC Been at Fife since March 2010. I'm deputy clinical lead in ED
MC My role breaks down to clin assessment of patients, supervision of juniors, and non-clin work eg referral letters, interacting w other specialities. And a large amount of teaching. Also critical incident review and some responsibility for oversight of dept and developing protocols.
JR How do u know SP?
MC I have worked w her since I started. We're not always present at nights and she work night shifts. We both work less than FT so might not crossover.
JR Did u know she held GC views
MC Yes, I'd heard her articulate them in non-clin areas

Yes, I feel like doing this for any reason should be taken very seriously because if you can do it for one thing, then it’s not a stretch to think you might do it for something even more serious.

I can't be bothered with all the detailed techie stuff so I'm just skipping the threads today and looking for headlines.

It's like when I read War & Peace. I couldn't stand all the pages and pages of fighty, boom-boom, shooty bits so I skipped them as I only needed to find out who was dead before resuming the story. In effect, I didn't read War & Peace, I just read 'Peace'.

This is the first time I have truly regretted the loss of our laughing emoji.

Dishonesty is a reason to lose your professional licence - if it’s one of the standards you are expected to uphold. Professional people - not just well educated people - usually have to register with professional bodies to be licensed to do the job they’ve qualified for. It cuts across many professions & is the reason that often a Dr or Police Officer etc. would have some weight added to their evidence as it’s expected to by honest.

Dr Searle alluded to it when she suggested that she believed DU because he’s a doctor & has to act with honesty & integrity at all times. If DU is found to have been dishonest - either when giving evidence, or in his statements to investigators, or in how he’s presented the digital evidence - it has implications that may not turn out well for him. But equally, it might be the reason the tribunal would be reluctant to accept he’s been deliberately dishonest - because he’s a doctor & is expected to be honest. That’s going to be a key factor IMO in the judgement. A lot of the wider detriments are from people not doing their jobs properly once the initial report was made of a ‘confrontation’ in the F Cr. But going as far as to deem DU dishonest, i think is something the tribunal may avoid making a call on.

Yes, but there is a difference between being dishonest and having a criminal record.

Would a doctor be struck off for dishonesty in a civil matter that was tangental to practicing as a doctor?

MC Me and another colleague. We interviewed 53 for 18 posts. Pre-employment checks done by HR including NHS Scotland checks, occ health to ensure ppl adeq protected.

Trans folks can be agents of transmisia as well (particularly when acting as representatives of cis-dominated systems, such as higher education) by perpetuating the notion of gender binary or "passing" superiority and using it to discriminate against other transgender people. For example, a trans woman at a company may refuse to hire a genderqueer person because their gender presentation might "confuse" customers, or a trans male administrator at a traditionally women's college may deny the application of a non-passing trans woman for not "transitioning enough."

It's such a lovely thing to have the relatively young C Elves doing the cross-examination. Upton probably thought he was getting one over the older generation with this.

In reality, many of us oldies were the ones that unpacked and set up the first computers as they were rolled out in workplaces, and we've owned every iteration of mobile phone, and we were the first ones to claim IT disasters as reasons/excuses for missing deadlines set by our presumed-to-be-tech-illiterate elders.

Oh sure. But to elaborate, I’m younger than DU and have a comp sci degree - hence being shocked from all counts that the IT witness was like it’s a mysterious error. Firstly tampering with screenshots - there’s many basic tricks a layperson would be aware of and tempted to do - hence why the supposed NHS expert testimony didn’t ring true. JR questioned the 2nd witness about his partiality but I think the same line of questioning needed to go to the NHS IT guy. I bet if the same happened in reverse, he’d have more to say…

It also seems quite crappy that the NHS can infer the issue lies with Google, without an expert from Google commenting on the likelihood of it. I reckon a Google expert would shut that down.

I have two middle names because DPs couldn’t agree which one. Sibs only have one middle each.
DSs have two as they have my maiden name, as there were going to be no others with that name. I wish I’d kept it myself, with hindsight.

I have NO middle names as DP's argued so much over the first one that they had no energy left for anything else.

Upton's use of 'sad times' and his histrionics make me wonder how he ever had the ability to get through his A levels and into med school.
