NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #42

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

And when MN introduced the edit function, most users very rapidly evolved their use of it to include tags such as "edited to add" whenever they changed anything beyond a simple typo. Cos we have a basic instinct towards transparency, innit.

I think he saying the opposite. That that is the only way that could happen i.e the BS google sync issue as suggested was to try and cover up the clear trail in the metadata that the notes were edited later and added ro and hence are not contemparaneous.

This may be what you mean, sorry, if I didn't quite get it.

My read is that the evidence shows that the notes don't match the days DU claims.

PD testifies that during the process DU said this was a glitch in the system not him, and that it had happened before so must be just a tech problem. PD says no reason to disbelieve DU.

JB says meta data shows notes have been edited.

He tests the system to see if he can recreate glitch claimed.

Your notes can have your creation date be different only after the fact, so if your phone is offline when your notes are uploaded when you reconnect the creation date is that date and time, not the date and time when you actually wrote it.

However, that can't be done before the fact. At least he couldn't replicate that possibility and doesn't see any way how it could. Ie that the problem here is that the version history can't become an earlier date, as is being presented by DU, only a later one.

Is this the guy who did a forensic analysis of Upton's phone? Or is he interpreting evidence already extracted from the phone? Or both?

He never got the actual phone - just some files

But Fife let DU download them himself on video call with Fife IT guy (previous witness) so not a full phone exam

I'm going to out myself now as somewhere between 'techy' and 'not very techy' (techy being a spectrum as we all know) but it sounds to me like this suggests it was a stitch up.

R - you weren't just asked look at notes, you were given specific part of notes. what were you told to do
JB - recover notes re patient care allegation
JR - why
JB - not told, just to do it

Could give rise to contempt proceedings or police Scotland could investigate for perverting course of justice (or Scot’s equivalent). They can seize the phone (if it hasn’t been dropped off the Skye ferry cf Wagatha case)
