NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #37

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

By saying "you can't prove that" Kate Searle actually lost control of herself.

It's a very revealing thing to say, and quite the lashing out. All her emails were lashing out at Sandie, and her repetition of kindness and compassion statements is just empty words.

She was still lashing out later on as we heard yesterday by dragging in nasty gossip about isms and phobias to try and keep the suspension going.

She's a bull in a china shop.

She's caused her nasty gang a lot of problems by ring leading them into this mess.

She's going to get a slating in the judgment. I doubt she has any ability for self reflection however. Any normal person would arrive tomorrow full of apologies for overstepping and getting it wrong. Not this woman, she's incapable of understanding the harm she's causing and has no self control.

If she'd said "I doubt that you can demonstrate that" you could infer that she knew it couldn't be demonstrated because it never happened.

The use of the verb "prove" carries a different inference, especially in a legal setting.

I hope the IT guy is as arrogant as KS.

This is more likely to be about timestamps on Uptons phone, to prove his notes were contemporaneous.

There is 2 guys coming 1 for mobile phone investigation and 1 for the local IT team. I suspect local IT guy has recovered the complete email exchange KS et al tried to bury. I imagine NC has that in it’s entirety and finds it interesting! Meanwhile the other mobile phone guy has also found interesting stuff on Du phone. Just guessing obviously.

I'm still struggling to understand, and have been struggling to understand since February how an organisation as large as the NHS doesn't have IT experts who trawl the emails of witnesses to make sure nothing is missed for the Tribunal. Is that what other large organisations do? Why would you leave it to individuals who (being charitable) might not be computer savvy?

If I were the judge, I'd have this on my Naughty List of recommendations.

Yes I think it has those implications widely- based in its origins (in the electromagnet spectrum), which is why it’s not helpful terminology to describe sex and I wouldn’t use it.

I also incidentally think it’s not helpful terminology when applied to other things- eg ASD:

I’ve been thinking about this.

“Engagement” in a changing room is very different for men. Male pattern behaviour in rugby and football changing rooms (I’m told - husband and son, male friends) and probably hockey changing rooms is lots of naked men, banter, walking around with your bits on show and sharing showers, chatting about the game whilst soaping your ball sack. Women, on the other hand, are more likely to embrace cubicles, privacy and showing as little flesh as possible. dignity and privacy is a whole different ball (no pun intended) game.

Women just don’t engage in changing rooms other than perhaps when you’re clean and dressed and drying your hair.

I also think there is probably a difference between sports team changing rooms and gym or work changing rooms for both men and women.
I'm linking gym and work together in the sense that you probably don't really know the lady beside you and not really engage beyond excuse me.

Ok we've all been in a nightclub to see 3 girls pile out the same toilet cubicle (you never notice them pile in) but that's really not something you do beyond your teens with a drink in you

I know this is probably old news for everyone in this thread but I’m just reading through the threads where DU is answering NC for the first time. I can’t believe what I’m reading. How are there people listening to his POV and thinking this is a normal stance? He has admitted he knew his presence was making her uncomfortable? He says bodies don’t matter when it comes to male/ female? Called himself a biological female? The whole plumber-gate? I’ve not even finished reading and have had to take a break.

SP is very brave to have said something, I’m not sure if I would have been brave enough to but I guess that’s the problem isn’t it? It can feel like we can’t call an orange an orange without backlash. Hats off to SP

I re-read his testimony a few days ago and thought to myself, if he is prepared to say those crazy things in a court, with media and public looking on, then there's nothing Sandie could have said to make him agree that he should leave the changing room to give her privacy from the male gaze. She was up against a brick wall of pure fantasy and her logic can't break it down.

However, his tears and rage that followed shows he knows what he is. It's just that no one is allowed to say it out loud.

On reflection, I think the right word is simply corruption. I remember Graham Linehan, when he used to do the fabulous ' The Mess we're in' podcasts, commenting that this ideology made it impossible for institutions to do their jobs properly. So you have journalists reporting violent men as ' women', politicians saying stupid things like, men can grow cervixes, judges telling victims of make violence in court that they have to call their attacker
' she', teachers teaching that There Are 100 genders etc and now we have experienced DOCTORS saying they don't know what sex they are and how a baby is sexed at birth. It's utter nonsense and tbh I will NEVER understand why so many seemingly educated pp have gone along with it. Never...
