Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

There's a tonne of evidence on how sex hormones operate on the structure and function of the brain and influence cognition. Think about it - why wouldn't they? The brain is a physical structure that is part of the body.

The series of events as so far understood, does support the claimant's view that there was no fair process followed.

We know that the Drs and senior nurses had already carried out and concluded their investigation via email, long before there was any talk of what the respondents are calling "the investigation".

There was no chance of a fair procedure or just outcome and I expect Big Sond and The Paunel already see that.

I'm very hopeful for success for the claimant and to learn some interesting new legal ways to say "bams were at it" in the judgement.

A better way to phrase it would be:

People observed male at birth genetically disposed to being less male than other birth males are more prone to experiencing unhappiness with societal expectations of living within a male-sex role than other birth males.

No but unusual variations in hormones at particular stages of development, or unusual variations in how the body responds (or not) to sex hormones, can create variations in sex development including psychosexual development

Oh come on, you know full well that there is barely a hospital department in the UK that hasn't had to deal with dozens of women complaining that other women are not stripping off in front of them. Basically a daily occurence, apart from in the more woke hospitals where the nurses all get changed together whilst giggling and having pillow fights and swapping tampons.

I'm really not trying to intimidate you - if you read recent posts the attempts at intimidation are clearly all the other way (a bit like this tribunal perhaps?)

Has it occurred to you that the doctors might be "repeating this claptrap" because they have medical training and therefore are actually knowledgeable about the biological complexities of sex development?

PPs have been asking about the 'missing' email thing. I was observing remotely so perhaps it was slightly easier to follow the ins and outs but of course I may still have misunderstood.

FWIW my understanding is that Maggie Currer's 'need to know basis' email was the last in a chain circulating amongst 6 individuals including KS. However it was disclosed only as a separate email during the hearing in February (I think Boswell is wrong when he says April, both sides in court today agreed MC's email was during the hearing in February). NC put it to KS that she and the others in the chain deliberately severed it from the chain when they were asked to trawl and disclose their emails in April/May because it was seriously embarrassing on several counts.

If so, this would amount to tampering with evidence.

The technical evidence from the Fife IT guy and/or the phone forensics guy is going to be very interesting.

There is precisely zero evidence at all about how misogyny and social contagion operates or that it's about 'trans'. There is no test for that. If there was a test, 'trans' people would be champing at the bit for it. The very fact that trans identified males are full of Male Entitlement and hateful and spiteful vindictiveness towards womens spaces proves they have Male Pattern Thought Process. i have seen a thousand of these things and not one of them ever suggested a link between trans and intersex til about 10 years ago curiously around the time we started to get force fed the sex isnt binary narrative!
