Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

It doesn’t make sense. They’re in March and still messing around with proposed shift changes. You can’t just keep saying you’re being “supportive”. None of this is supportive. It’s infuriating.

Did Upton get a contract extension then? I thought in Jan he only had 4 shifts left, so how are they still needing to separate them in March??

My impression of LM is that she is a more open and less guarded witness than previous ones - so far at least. She hasn't come across, to me at least, as ideologically committed.

I think CM has shot herself in the foot by stating they have to treat them as the sex they identify as. Reasonable as she is coming across I am looking forward to the cross examination.

Re just scrolling past the irrelevant posts, I know there will always be a bit of chat but you filled 12 pages with soup and snibs while waiting for today's session to start. That's over quarter of a thread, and puts a much greater burden on poor nauticant than necessary (as well as those trying to catch up).

We have also filled a few pages answering questions that have already been replied to multiple times and explaining things to people who have spent less time in the weeds. We are trying to be helpful and are glad to have new people join us. Perhaps it would be OK for us to have a little fun along the way?

JR What did u mean by it being a sensitive Ix?
CM I wanted the Ix to be completed before her full return. It was both a protective measure towards her and to prevent her saying anything inappropriate.

I assume suspension is the same but I'm not 100% on that.

Interesting. CM has said patient safety concerns were raised when they were planning to bring her back to the workplace. But that she challenged these asking if they had been documented.

And we all know the answer to that
