NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #31

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

Mind you, I admire the commissioner's forbearance and stamina for being able to wade through that interminably dull pile of whingey drivel to the end. I'm afraid it was something of a "Lord, take me now" moment for me.

Yes, there are plenty who are invested in gender ideology who believe exactly that. I've certainly had "anti-trans" flung at me for saying something similar. If it was meant to sting, it failed.

But it's just such concrete proof that there is NO room for being kind, being polite, using preferred names, pronouns etc UNLESS and UNTIL you are also prepared to share sss and get undressed with the too.

It's brilliant for SP case because it is so clear that her protected GC belief could not be accommodated in this organisation but it should be a very clear message to all those who say "couldn't you just..." because it is never ever enough.

Just caught up. WTF were Fife trying to do with that statement?? SM is a campaigning organization. They literally exist to influence public opinion. It is their fucking job. Yes it sucks when you only have the Fox Botherer in your corner, but you can't blame the women for that!

Yes, they are limited in what they can say. What would they say if they had the chance??? They have been shown to be so wrong and incompetent at every step. No understanding of the law, no policies, no record keeping and a process utterly biased from the start.

I am sure it is gotten really nasty behind the scenes on all sides. But it was them who called SPs daughter and husband to the stand, dragging her family right into front and centre. A horrendous low blow, I think designed to highlight her working class origins.

Why are they so worried about public opinion? It is not the public who will be passing verdict on this utter shit show. It will be the judge. I didn't think I could have a lower opinion of them, but they reallllllly plumbed the depths with this one. I can't wait until they get their arses handed to them on a plate.

The decision related to making reasonable and proportionate searches for information they might hold on costs of the case in response to FOI requests. I think Fife said they didn’t have the information directly and had to request it.

At this point it won’t fit into a film. We were heading for a mini series (I’m thinking like ‘A woman of Substance’), but after today’s malarkey, it’s more like one of those endless series where you have no idea wtf is going on. Like ‘Twin Peaks’ or ‘Lost’

Some time ago the press (I think) put in a Freedom of Information request to NHS Fife asking them to reveal how much they had spent on this case. They refused to supply the information. This went to the Scottish Information Commissioner who told them they had to release the information. NHS Fife were not happy. Just how unhappy they were was revealed in a data breach when a mother requested her son's medical records and, instead of sending them, NHS Fife sent her a copy of his judgement with comments from Fife branding him emotional, selective and not professional. However, NHS Fife told the Commissioner that they would comply with his judgement.

Fife's statement this afternoon throws doubt on whether they have complied fully with the Commissioner's ruling. If they have not, that is contempt of court and could be very costly for them.
