Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

If I were JR, I'd be advising them to settle by Monday. If the judge is pissed off with them, Sandie's settlement will be even bigger than we expect.

I honestly don't know how Sandie can go back and work in that hospital with these witnesses.

after watching this you can see why SP hasn’t settled at all. she is a racist but sorry we don’t have any actual evidence. The witnesses have all be a bit evasive with can’t remember, can’t recall, maybe, no notes blah blah blah.

Total stitch up. Carol Potter and the board have no control over what is going on. I am assuming that a press release like that would need board approval.
They don’t want KS stuff tweeted or reported upon - that’s NC’s hammer blow and Fife know it.

I know men who cried when confronted about their negative actions. It’s a despicable form of manipulation. Entirely engineered to elicit sympathy especially from women. And shame on the BBC for using that emotive headline in their despicable attempt to engineer sympathy for DrU.

They seem to be implying that a women's rights activist who is a barrister should somehow not be a barrister for someone asserting her rights as a woman. I can't follow this at all. Are they suggesting NC is biased? Yes of course she is. She's literally there to argue Sandie's case just like JR is there to argue Fife's (such as it is). Why on earth would it surprise or compromise anyone that a women's rights activist uses her skills to that end? NC's role at Sex Matters is public information.

I don't know, is this the kind of insanity you only understand if you don't know what sex you are? We're all mad here....

It fits into the current tactic of referring to something called 'GC Ideology' mirroring [as they keep doing these days] our use of 'trans ideology'.

The difference is that we're not promoting a counter-ideology, we're promoting scientific fact, and stating that human sex is binary and immutable is not ideological.

But if GC is an ideology, SM & NC are promoters of an ideology, exactly the same as TRAs promote theirs, and so are incapable of objectivity.

Which is not a great thing to say about a barrister...

There was an ET judgment on Twitter the other day, where it was concluded that the claimant would be unable to continue in their role. Their award was salary until retirement plus associated pension contributions.

I don’t suppose anybody else saw it?

I think it might have been another NHS case, nothing to do with GC, and I don’t think the claimant was physically injured.

The past few days have made me feel even sorrier for Sandie Peggie. Sad.

I've always thought working in A&E must be a particularly challenging area of nursing/medicine. But I've since revised that opinion. It must have been sheer, unmitigated hell to have to work alongside such thick, incompetent, smug and duplicitous colleagues everyday - the patients would have been light relief.

I’m interested to know what they suggest SP should have done to resolve the situation instead of taking them to a tribunal.

From what I understand NHS Fife lawyers are still (bravely) planning to argue that the SC judgement only applies to the EA and doesn’t apply to changing rooms (KR said toilets, but am assuming she misspoke).

Cowered. Taken the demotion, the loss of shift pattern, work place and the ability to talk to colleagues, family and friends about her day and just shut the fuck up.

To be clear NHS Fife is not seeking to suggest that anyone involved with Sex Matters have contributed to the behaviour or issues mentioned above.

Someone's had a word.

JR has told them about NC’s reaction. Or maybe Carol received a phone call from MF saying our lawyers will be in touch.

so Fife issued a statement, archived it and have already had to issue a new version.

It’s not going well for them.
