NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #31

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.
Access to view the hearing remotely was obtainable by sending an email request to [email protected] by 5pm on Wednesday 9 July. Detailed instructions were provided here:

Absolutely no attempt to balance Sandie’s rights against Upton’s.

That answer could be the most damning admission of the whole tribunal.

I cannot get past the fact that when all of these women were told Upton had the right to use the female changing room, that all of them stepped back and complied. I shouldn't be shocked, I know that, because I seen first hand how quickly women scramble to protect abusive men. I've seen it first hand. But I still am. It makes me both furious and sad at the same time.

Positive discrimination for disability and pregnancy is expressly allowed (in different terms). No exception is made to allow positive discrimination ion for GR people.

the EA2010 doesn’t say (for direct discrimination) that B is discriminated against by A because of a protected characteristic held by B - it just says because of a protected characteristic.

For indirect discrimination it specifically states “because of a protected characteristic held by B.” The omission of the three words in direct discrimination is significant.

EHRC website only admits to 'anti-trans', not 'anti-cis' discrimination being illegal. Also says single people are not protected from discrimination versus married and civilly partnered people, despite the lack of specific language to that effect in the Act.

There has been significant and very polarised debate on social media regarding the case and associated issues, throughout. In some cases, however, what began as debate has evolved into much more worrying behaviour, including a threat of physical harm and sexual violence, which has required the involvement of Police Scotland.
