Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It will resume on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

Impossible to say for sure, but it blows the defence Fife have been running (that SP is a bigot who deserved punishment) out of the water. Their only possible defence now is to argue that they've followed the correct process in dealing with these allegations, but I don't think that flies and, in any case, it fails to take into account their failure to provide a single sex changing room for women, as required by law.

Upton can stick with the defence arguments to date, but he will be on his own if he does so. As Michael Foran says, NHS Fife agreeing to joint representation with Upton and funding his defence was a huge mistake. They assumed that their interests were identical, which was only true if SP didn't have a case. I cannot see any way Fife can now defend their position without abandoning Upton, and I don't see any way Upton can defend his position without attacking Fife.

It's a personal choice @Pinkrabittbut while the hearing is in session I'm not going to comment on anything I see or hear as an observer. (Assuming I do see and hear things.)

Translation: we will have an ice-breaker session followed by some sub-group exercises, and by the end of the session we will have a collection of post-it notes with vague concepts. This will be written up into a report or possibly a Powerpoint presentation, which no-one will ever read. We won't talk about this ever again.

If they want to continue to defend themselves, I expect this to be their defence. I'm not convinced it flies and, even if it does, I don't think it helps Upton.

I think that's accurate. TT and others on the inside have to have approval from the court to tweet or otherwise release information during proceedings. Once it's on "the outside" then we can discuss it further.

Any mumsnet users or others without such approval, should not be tweeting or posting live details from the hearing, is our general understanding, I think.

I’m so disappointed not to have been given access to this. I applied about 20 minutes after the instructions were published, with my own name and disclosed my professional interest. (I wonder what criteria were actually used to determine who to admit, because it couldn’t possibly have been simply first come first served based on some of the times of application reported here?!)

I’ve had the blank grey screen since 9:28 on my iPad using Safari. I have Chrome (thank you @nauticant) but without a link I can copy and paste I can’t use it.

I’m now on the computer using Chrome, and I just get a screen full of cameras crossed out and lots of names. No sound
