NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #27

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It will resume on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

I imagine that there is going to be a fair bit of discussion with the judge before things get going this morning. It just adds to the accusation that Sandie was being harassed.

Presumably an adult told NHS Fife to get their act together.

Genuine question. would the legal teams not have had contingency plans for the possible outcomes of the disciplinary?
No doubt there's lots of frantic legal argument shuffling going on as we speak, but they always knew this was possible.

It really shows bad faith to make this announcement the evening before the tribunal. Its such suspicious timing, I dont think the tribunal will have much patience with Fife claiming it now needs a postponement.

I haven't RTFT please could someone direct me to what the new reporting/discussion rules are? Are we not allowed to discuss TT tweets during the hearing?

Does the disciplinary action mean that a GMC complaint can be made against Dr Upton or would that depend on the outcome of the Tribunal? Is it in Sandy's interests to get a Tribunal decision in her favour?

She must feel she is near the end of this nonsense now.

Great news and the right result but the cynic in me says releasing this the night before the ET resumes is to try and get a settlement and if not reduce damages.

I thought their statement yesterday was interesting as it implied Sandie refused to settle so Sandie is responsible for Fife’s costs which are paid by the tax payers.

Clearly someone at Fife has taken a sensible pill or maybe they started to listen to HR. HR are often derided but in the Jo Phoenix ET the HR Advisor witness (not the HR Director) was the only one who acted properly.

Where can I find the statement NHS Fife made yesterday please?

The four + month delay before this second part of the tribunal, which seemed so long and frustrating and hard on SP, mean that is now happening after the Supreme Court ruling that women have always existed and still do, and that women have a right to single-sex spaces and always did.

Fife didn't really have any choice but to withdraw charges on those issues, leaving the claims of putting patients at risk the only things they had left. And this makes it clear they always knew they were at the very best shaky.

I wonder will BU have a fit of vapours and get signed off sick by a fellow-medic. It would be a good way to make their position even worse.
