Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It will resume on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

Access to view the hearing remotely was obtainable by sending an email request to [email protected] by 5pm on Wednesday 9 July. Detailed instructions wereFri provided here:

If this thread gets locked, I think others will just be created. I reckon the best course of action is to report sabotaging posts and not engage.

I can't see how it can go against her, given the SC ruling, and yet now it's here, I'm nervous.

Best of luck to Sandie, we're all with you!

Task list for this morning

Early Tesco shop so I can be back for the start ✔
Popcorn at the ready✔
bingo card✔
soft cushion in place to hit head against✔
Prop to support dropped jaw✔
Anger management pills✔

now I'm all set for the tribunal. 😁

EternalLodga · 16/07/2025 07:57

It absolutely sucks that we cant watch along. How hard is it to just set up a live cam and give people a link?! No need to have a convoluted log in process

Seriestwo · 16/07/2025 08:00

I suspect this is going to be electrifying.

the potential for consequences reaching John Swinney are higher than your average employment tribunal - I have no background in law or HR and I am hooked.

i am particularly interested in what Dr Upton will be wearing as there is no need for scarves to hide faces in the summer.

Igneococcus · 16/07/2025 08:03

I bet there will be a lot more journalists watching/in the audience than the first time.

I don't think Upton will be attending unless recalled for cross examination regarding what has been found on his phone.

Morning or afternoon? I have read both on here and can't find where I saw the time!

Shetlands · 16/07/2025 08:06

Sending all good wishes to Sandie today. 💐

I wonder if she realises how many of us will be ignoring avoiding postponing also doing household chores, work commitments etc while following proceedings. 😎

BezMills · 16/07/2025 08:12

Mon Sandie! Mon Naomi!

Ereshkigalangcleg · 16/07/2025 08:15

Abroad so can’t watch this time, will be following TT and here. Good luck to Sandie and her team, not least brilliant Naomi! Let’s go to work!

Needspaceforlego · 16/07/2025 08:15

Good luck Sandie,

I'll catch up later, just started a new job so can't get away with getting engrossed in this stuff today.

ArabellaScott · 16/07/2025 08:15

Sandie cleared of all allegations.

Ereshkigalangcleg · 16/07/2025 08:16

Oh wow!

ArabellaScott · 16/07/2025 08:16

'A nurse at the centre of a high-profile tribunal case has been cleared of all internal disciplinary charges, including allegations of patient care failures and claims she had misgendered Dr Beth Upton, a trans woman doctor, in a changing room in the Victoria Hospital in Kirkcaldy.

In a statement, Ms Peggie's solicitor, Margaret Gribbon, said: “On Tuesday, 14th July, the evening before the resuming of her tribunal, Sandie Peggie received confirmation from Fife Health Board that following a disciplinary hearing, none of the gross misconduct allegations against her were upheld.

“This follows a disciplinary hearing on 25th June, which considered four gross misconduct allegations: two relating to patient care failures, one of ‘misgendering’ Dr Upton, and one relating to her encounter with Dr Upton in the workplace female-only changing room on Christmas Eve 2023.

“Sandie is relieved and delighted that this 18-month-long internal process has concluded and cleared her of all allegations.”'

Vegemiteandhoneyontoast · 16/07/2025 08:17

So they've admitted the allegations were false? Shouldn't this now come back to Dr Upton?

alsoFanOfNaomi · 16/07/2025 08:18

Goodness! So how do they handle their defence now? We honestly thought she had committed gross misconduct, do they say?

Ereshkigalangcleg · 16/07/2025 08:18

I wonder what effect this will have on the case?

DeanElderberry · 16/07/2025 08:18

about bloody time, but what happens next?

GetDressedYouMerryGentlemen · 16/07/2025 08:18

Excellent news. And rather undermining for Fife's position. Bring it on.

ArabellaScott · 16/07/2025 08:19

Cannot imagine how this is going to pan out. At all. 😂

Any lawyers able to say if/how this might affect the soon to resume proceedings?

Shortshriftandlethal · 16/07/2025 08:20

Maybe they are hoping she won't bring her own charges against them.

... Nice ...

Michael Foran writes "It will be interesting to see if this will change the approach of counsel for NHS Fife and Dr Upton in the Tribunal." Indeed.
