NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #23

nauticant · 02/03/2025 12:52

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It is planned that it will resume on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

Access to view the hearing remotely was obtainable by sending an email request to [email protected] headed Public Access Request (Peggie v Fife Health Board) 4104864/2024 and requesting access.

However, as a result of problems with the livestreaming, apparently caused by a very large number of observers, remote public access to the hearing was suspended on Tuesday 11 February. It was suggested that it might be reinstated at some point but don't count on it.

The hearing is being live tweeted by https://x.com/tribunaltweets and there's additional information here: https://tribunaltweets.substack.com/p/peggie-vs-fife-health-board-and-dr. This also has threadreaderapp archives of live-tweeting of the sessions of the hearing for those who can't follow on Twitter, for example: archive.is/xkSxy.

GMC Response to complaint: What an utter cop-out

The GMC cannot consider any investigation into concerns which are still subject to statutory or legal
processes or provide any comment on them. The concerns you have raised, which are subject to
ongoing matters being considered by the Tribunal, duplicate those that we have received from
another complainant. As such, we regret to inform you that we won’t be able to update you as to the
outcome of our considerations.

I got a similar cop out, except they can’t update me as I don’t have a direct connection to the Claimant or Dr Upton.

Wankers.

Same here. Now need to find a good Sim-only phone deal to pay for it!

fanOfBen · 22/03/2025 09:10

do you actually need a contract/handset with it SqueakyDinosaur? I just use pay as you go with Three - specifically, I pay £10/month, and with that I buy a bundle which gives me comically much more of data and everything than I ever use (but I haven't found a way to pay less and get less). My DS does something very similar with O2 so I think there are a lot of options here. This does mean than I have the extra expense of buying an actual phone every few years, but we're getting to the point where they last a long time and there's a lot of choice of pricepoint. Now back to thread topic :-)

MarieDeGournay · 22/03/2025 09:12

It's great to see all the donations !Smile
Although I did the emailing - which means that I've had an email exchange with the wonderful NC - you may touch the hem of my garment😉 - it was somebody else who originally suggested donating to Sex Matters because of NC being Chair of their Board of Trustees.

I can't remember who it was and there aren't enough hours in the day to look back through the thread to find you, but thank you for getting the ball rolling with that excellent suggestion!

Hey look, we've manage to re-rail the thread back onto to the SP case, it went all nautical there for a while, with port/starboard and all that, didn't it?

That's OK - we are large, we contain multitudes😄

FarriersGirl · 22/03/2025 10:09

Donated

I think it was my suggestion, @MarieDeGournay and I'm likewise delighted to see that lots of people are donating.

Thank you both for thinking of this idea.

I wonder if NC would do a Mumsnet chat? I'd far rather hear from her than any number of spineless politicians.

Although I do worry you will all be upset when she agrees I'm her favourite mumsnetter

Sex Matters haven't been back in touch, but when I emailed about the onscreen comments vs anonymity thing, it took them ages to reply - I think they are very very busy women!

As soon as I get a reply from them, and an indication that they've noticed that they are receiving all these extra donations, I'll post it here.

Margaret Gribbon hasn't replied either, but I only had a general email address for her, it's probably working its way through the channels. Likewise about posting it here as soon as I get it.

NC on the other hand - practically by return of post, but then she's perfect, isn't she?😊

Perhaps your name, @MarieDeGournay attracted her immediate attention as someone rightly concerned with Ladies' Grievance.😀

Well spotted, Lark1ane!

So all that long-term planning - learning French at school, getting a degree in it, moving to France, reading Montaigne, discovering his gal pal Marie de Gournay, struggling with her 16th century French prose - it was all worth it in the end, it caught the eye of the peerless NC!

And who better to deal with a Ladies' Grievance than a barrister?😂

I used to be an extreme microbiologist, I mean, I used to work on microbes from extreme environments, including deep sea hydrothermal vent systems but also terrestrial hot springs like in Yellowstone or NZ (never Iceland sadly). I went out to sea few times (several times in the Pacific and once Indian Ocean) always on ships that carried submersibles and I went diving in Alvin once to 2000 metres (I talked about that a bit on the Titan threads). I also spent a lot of time hiking to remote areas of Yellowstone and New Zealand, once into the caldera of Mt St Helens to take samples. I loved it, I still know lots of people who do this kind of work.
I'm still a microbiologist but I work with less extreme organisms now. I still carry a bsaic sampling kit with me in the car because you never know when you see something interesting :)

Just catching up with this thread. How fantastic, sounds so interesting.

Porton Down scientist with GC views wins at ET:

guinnessguzzler · 23/03/2025 06:36

Great news but what an absolute mess. How many good workers have been lost from the public sector because of this nonsense? And where were the main civil service unions, dare we ask?! And to see this behaviour from 'scientists' frankly makes me question our entire education system and the quality of their qualifications. Just like with the doctors in the Sandie Peggie case, it is very hard to take them seriously when they buy in to a load of nonsense that is just not compatible with a basic understanding of biology.

KnottyAuty · 23/03/2025 07:50

And the Lib Dems have now backed down about their own GC group after being told they’d lose a costly legal battle:

https://archive.is/nAcUF

“The legal case we brought finally gave party officers a reason to overrule the trans lobby on fiduciary grounds”.

edited to add - my emphasis with underlining - I think it’s going to be the money/threat of loss due to legal action which will turn the tide.

SinnerBoy · 23/03/2025 08:48

Jeez, I hope she wins her case. What a disgusting situation, I hope the doctor will see her. It's similar to Sandie Peggie's case, they are squeezing her financially. Bastards.
