NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #6

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 January 2025 and is expected to continue for 2 weeks. The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton started giving evidence on 6 February.

The judge is being very thorough, I like it. He's highlighting the 'as discussed...' comment, and asking if Esther was really just receiving documents, or was she asking questions.

Chair seems to think that ED was involved in an investigation. JR is faltering.

JR - limited to the activity to receiving those two statements - I dont' know who asked Louise for the statement.

Please could someone in the know explain why Esther can't be cross examined to clear all this up.

JR - it IS possible to do the searches asked for, but the manager is not available, but someone else is.

The consequence will be that this will take a few days possibly more, because every page need to be redacted manually, patient data, etc

Why would there be patient data in the HR documents??!!!

NC - not clear why patient info would be included. No redactions so far.

FFS you pull in all staff in information governance over the weekend you order in pizza and you get it fucking done.

She's trying to make the point that the search of the it system would be prohibitively time taking so.... eh, lets not bother.

NC - comms between managers, HR, witnesses, about an investigation, no reason for patient data

This is the point now being made I feel.

NC - there's been no redaction of patients data so far so no reason to think info we ask for might contain it.

If it did contain identifiable patient info that would be another error on NHS Fife part.

NC - we don't want to adjourn. We will accept the respondent won't get IT dept to do those searches.
