Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 January 2025 and is expected to continue for 2 weeks. The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton started giving evidence on 6 February.

Access to view the hearing remotely can be obtained by sending an email request to [email protected] headed Public Access Request (Peggie v Fife Health Board) 4104864/2024 and requesting access.

The judge is being very thorough, I like it. He's highlighting the 'as discussed...' comment, and asking if Esther was really just receiving documents, or was she asking questions.

Yes, she's playing lick arse, complete with fake laughing...

Oh yuk. I'm glad I'm not watching/listening.
So she has nasty mode for SP and pandering/laughter like the tinkling of silver bells mode for Dr U,and now that she realises she may have got on the judge's nerves..

nauticant · 07/02/2025 14:30

Chair seems to think that ED was involved in an investigation. JR is faltering.

Loving the judge right now

ArabellaScott · 07/02/2025 14:31

J - your understanding is that the role of Esther was not a full investigation but ... what was it?

JR - limited to the activity to receiving those two statements - I dont' know who asked Louise for the statement.

Yes, he seems on the ball.

JR seems a bit out of her depth here.

ArabellaScott · 07/02/2025 14:31

JR - Louise Curran volunteered that statement. It appears

J - those two statements? Nobody else was spoken to?

JR - my understanding, but will confirm

JasmineAllen · 07/02/2025 14:32

Please could someone in the know explain why Esther can't be cross examined to clear all this up.

GruffaIo · 07/02/2025 14:32

JR's upbeat return to the fray post-lunch already faltering. Love to see it.

ArabellaScott · 07/02/2025 14:32

JR - it IS possible to do the searches asked for, but the manager is not available, but someone else is.

The consequence will be that this will take a few days possibly more, because every page need to be redacted manually, patient data, etc

HornyHornersPinkyWinky · 07/02/2025 14:32

IT request will take a few days...maybe Monday won't go ahead so.

CriticalCondition · 07/02/2025 14:33

JR .it is possible to do searches NC has asked for. One person not available but someone else is. Would take several days because have to redact patient info.

MJHereWeGo · 07/02/2025 14:33

Why would there be patient data in the HR documents??!!!

ArabellaScott · 07/02/2025 14:33

JR - Hearing would need to be adjourned

NC - not clear why patient info would be included. No redactions so far.

Boiledbeetle · 07/02/2025 14:33

FFS you pull in all staff in information governance over the weekend you order in pizza and you get it fucking done.

nauticant · 07/02/2025 14:33

JR falls back on her position that full disclosure will require adjournment and must be avoided.

katmarie · 07/02/2025 14:33

She's trying to make the point that the search of the it system would be prohibitively time taking so.... eh, lets not bother.

HornyHornersPinkyWinky · 07/02/2025 14:33

JR's last words 'have I left anything out'...a bit rich considering the whole cock up of missing documents.

ArabellaScott · 07/02/2025 14:33

NC - comms between managers, HR, witnesses, about an investigation, no reason for patient data

katmarie · 07/02/2025 14:34

MJHereWeGo · 07/02/2025 14:33

Why would there be patient data in the HR documents??!!!

This is the point now being made I feel.

CriticalCondition · 07/02/2025 14:34

NC - there's been no redaction of patients data so far so no reason to think info we ask for might contain it.

StellaAndCrow · 07/02/2025 14:34

If it did contain identifiable patient info that would be another error on NHS Fife part.

ArabellaScott · 07/02/2025 14:34

NC - we don't want to adjourn. We will accept the respondent won't get IT dept to do those searches.

ArabellaScott · 07/02/2025 14:35

5 minutes to consult

Boiledbeetle · 07/02/2025 14:35

NC five minute break to take instructions
