nauticant · 07/02/2025 12:34

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 January 2025 and is expected to continue for 2 weeks. The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton started giving evidence on 6 February.

HR 101. Absolutely basic. Shocking that the NHS does not have HR who understand the legal requirements of investigating a complaint.

Indeed. I have been approached several times in my career to interview for NHS HR roles and haven’t and wouldn’t touch it with a barge pole, on the basis that I consider myself competent at my job and couldn’t stand to act the way the HR teams in NHS seem to.

I haven't kept up with this thread so apologies, but has anyone else noticed how many undated (and important) documents were undated? Iirc, we had DU's 'hate incident' and 'formal complaint' undated, for starters. I'm sure there was one other at least.

Methinks Fife Health Board do not run a tight ship.

I don't understand this either. Literally the first thing we did every day at school was to draw a line across the page under the previous day's work in our exercise books, and write today's date (top right, underlined with a ruler). It's about as basic as admin gets.

ickky · 07/02/2025 14:21

People filing in the room now.

SelfPortraitWithHagstone · 07/02/2025 14:21

Glenn Close as NC? David Tennant as DU?

The start of people entering the room

@datun but if the exact same man used the female changing room without uttering the magic words, he would not be allowed in there and the woman's complaint would be immediately upheld.

Powerful things, magic words.

Glenn Close as NC? David Tennant as DU?

He's played a comedy transvestite before, in the days when he wasn't consumed by his own moral piety.

katmarie · 07/02/2025 14:22

Ohh something happening

@MarieDeGournay i am a complete amateur obviously! Although DH does furnish me with posh coffees from time to time.
Will do better from Monday 🫡

Frozen home-made choc-chip cookies, pre-portioned in scoops and ready to be whisked straight into the oven, are very useful in these circumstances, I find.

Just saying.

David Tennant is far too small. I think Greg Davies would be much better.
edit: because I've read Dr U is 6ft 6

Vegemiteandhoneyontoast · 07/02/2025 14:23

Thank you to everyone taking notes on this, it's much appreciated!

I'm enjoying this tribunal very much and am looking forward to NC getting to gnaw on DU.

Tom Davies would be good...

Ineedashero · 07/02/2025 14:25

Is DU not coming back today?

ickky · 07/02/2025 14:25

NC they have found another 4 emails.

Oh what a surprise

chilling19 · 07/02/2025 14:25

Ooh paginated!

So Dr Upton not being questioned until next week on Monday! Bugger!

Lunchtime.

Judge says

"Back at 2.00 pm"

I'm hopeful that they don't want to delay further so my guess is 2.24 pm

Ooh do I win with 2.24 pm?

MysticCatLady · 07/02/2025 14:26

MSF = multi source feedback

Basically we have to ask our colleagues to anonymously fill out questionnaires about our performance. As a trainee it was in every job. As a GP it is every 5 years. Not sure what the situation is for hospital clinical fellows.

Is DU not coming back today?

He doesn't need to return until Monday for NC's cross.

nauticant · 07/02/2025 14:27

JR: ED was not an investigator and did not carry out any kind of investigation. She just received emails and documents.

Is JR hoping for a sticker?

She's come back very upbeat and clearly hoping to explain this all away as minor admin issues.

Yes, she's playing lick arse, complete with fake laughing...

GruffaIo · 07/02/2025 14:29

J making clear that he really does wonder if ED was investigating! JR struggling :)

CriticalCondition · 07/02/2025 14:29

Judge to JR - well it might be obvious to you ...
JR - tinkly laugh

He doesn't need to return until Monday for NC's cross.

You'd think he'd want to be there to see what was going on. I certainly would!!
