NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #6

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 January 2025 and is expected to continue for 2 weeks. The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton started giving evidence on 6 February.

She doesn't seem that bothered that load of evidence her side were supposed to produce is missing.

She's saying that producing the docs that were asked for in the original judge's order is too much bother.

JR is using the threat of an adjournment that everyone wants to avoid to get everyone to accept there won't be a full search of potentially relevant documents.

Basically we have to ask our colleagues to anonymously fill out questionnaires about our performance. As a trainee it was in every job. As a GP it is every 5 years. Not sure what the situation is for hospital clinical fellows.

I don't believe for a milliseconds that no records were kept of all these conversations and meetings. I used to be a medical workforce manager and made notes of every single conversation - who was there, what was said, any actions that needed to be undertaken. And every email trail was filed carefully just in case it was ever needed.

We dealt with contentious issues such as doctors' pay banding/rotas/working conditions etc and even the most junior staff in our dept knew how important record keeping was. It beggars belief that other trusts would fall so far short of the basics. Interestingly, if we every had internal hearings, the BMA were always very hot on us disclosing to them, but their bundles were always shambolic and missing vital documents.

I've been in NHS meetings where nothing was documented...

(I'm not suggesting this has happened here)

I think if they continue without another search, it could only be concluded that there were documents that have been deliberately not disclosed.

I cannot believe that they would have all these investigations and discussions without documenting it, how would they remember what is said and by whom. If only to protect yourself.

It really sounds like they're trying to cover up a smoking gun. Delay, avoid, too difficult blah de blah. Patient records - what have any patients got to do with it? Nothing, that's what. Goodness knows what the missing documents contain since they already seem to have not followed procedure and not followed the law. It must be bad!

And I guess the thing with the search is that they're looking for specific documents, that NC team have deduced are missing. So they can narrow it down.

I'm sure if they gave one of us wimmins here access to their systems we'd find the documents for them by the end of the afternoon!

Adjournment would be unfair to Sandie. Better if NC tries to get investigation ruled as inadequate on basis of Fife's refusal to produce information.
