NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #6

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 January 2025 and is expected to continue for 2 weeks. The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton started giving evidence on 6 February.

@happydappy2 I think a black screen normally means you should try a different browser? You should either have live footage of a very boring room with a grey carpet or a white screen with a coat-of- arms, a warning that you can't record or transmit, and a nice man repeating "Waiting for the conference host to join", which means you haven't been let in yet.

NC calls JR 'Ms Russell', but JR calls NC 'my opponent'.

But, according to JR - "busy A+E department so lots things are done via Teams" Judge helpfully suggested that even Teams meetings could have notes taken . . .JR clarifies that no one took notes!

Can some legal person confirm that workplaces must have male and female CR ie that applies to CR only? What about toilets? Can they be unisex if they’re fully enclosed? But if a toilet also has a changing cubicle, what then?

That is entirely the point of this tribunal it seems - to define what the law is about CR. If you want lavs too then you will need to get a separate complaint going 😂

I don't know about ETs, but in court it's better to say 'my learned friend' if your oppo is a barrister. I do not consider 'my opponent' to be as polite, but perhaps it's standard in ETs?

And just taking a minute to step back and acknowledge what a colossal and unhinged basket of insanity this all is.

A man says some magic words that no one believes, including him, to gain access to undressing women in their own changing room. And everyone goes after the women for objecting.

The number of Intelligent, educated, probably otherwise very reasonable adults involved from beginning to end must be huge.

It's absolutely insane.

I wondered that too, Arabella - is it normally "my colleague" or similar? Or "m'learned friend"? Could it be a Scottish legal thing, like "disclose" vs "produce"?

Either way you certainly don't get much of a sense of friendly respect between them, do you? Not like NC and the barrister in the ERC case - I remember some laughter when she asked a witness if she thought he was a man or a woman...
