nauticant · 06/02/2025 17:34

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 January 2025 and is expected to continue for 2 weeks. The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton started giving evidence on 6 February.

Access to view the hearing remotely can be obtained by sending an email request to [email protected] headed Public Access Request (Peggie v Fife Health Board) 4104864/2024 and requesting access.

NC this shows a lack of judgment on the part of Dr Kate Searle - it seems unlikely that that is the only time Kate Searle emailed colleagues in terms which she shouldn’t have

I wonder what the BBC headline about the case will be today?

DrU misgendered in court

prh47bridge · 07/02/2025 12:41

ThatsNotMyTeen · 07/02/2025 12:37

Can she ask to have their response struck out?

Yes, she can if she thinks that is appropriate.

If I had to guess, his parents look like recently retired GPs.

I do feel for them. What an awful situation to be in - especially if they have their own disquiet about what their son has been up to.

ChazsBrilliantAttitude · 07/02/2025 12:41

I wonder if we are going to see the docs or a rapid reverse ferret by Fife to a settlement and apology.

I suspect they might try and settle now too, thus doesn’t look good for then either way so they might go with damage limitation.

ArabellaScott · 07/02/2025 12:42

'Claimant has been labouring under a considerable disadvantrage in preparing by not having all relevant docs, complying properly is essential to put on equal footing'

'We want to ask you to make specific directions '

Judge asks if she will draft something. NC agrees.

I wonder what the BBC headline about the case will be today?

"Drag Queen asked for comment on how mean Scottish nurse was" - because they ask Drag Queens for their views on everything. It's as if things don't even exist if a Drag Queen doesn't have a view on them

ickky · 07/02/2025 12:42

JR I object to the application. Yeah I bet you do

StellaAndCrow · 07/02/2025 12:42

Claimant has been under a distinct disadvantage in preparing for this hearing, so needs full compliance to put parties on an equal footing. We therefore need specific orders

NC will draft search terms

Sarahbackinthesaddle · 07/02/2025 12:42

Who's this talking now?

fanOfBen · 07/02/2025 12:43

JR: "I object to the application of course" - she kind of has to, but she doesn't sound as though her heart is in it!

PoshCoffee · 07/02/2025 12:43

OhBuggerandArse · 07/02/2025 12:41

Yes I do too. They’re not idiots, they can see how bad this is.

Oooh the judge not happy

'What we saw 9pm last night confrims that 'hate incident' was submitted in Jan, makes no reference to [x] incident, or that Dr Upton had been aware of safety concerns'

'Gaping hole in respondent's compliacne with judge#s order'

'Dr Upton's patient safety concerns are not in the Xmas day email sent'

'Dr Upton made no allegations of patient safety concern in december as far as we're aware'

Sorry if this has been answered - does this contradict Dr U's statements in court yesterday?

prh47bridge · 07/02/2025 12:44

ickky · 07/02/2025 12:40

Could the Judge find NHS Fife in contempt for not disclosing?

Yes, but that would be unusual.

ArabellaScott · 07/02/2025 12:44

Judge reading order .

JR: This is not a roving public enquiry

Judge - the order says what it says. If you think it goes too far, you are seeking to overturn the order?

CriticalCondition · 07/02/2025 12:44

NC will draft the terms of an order for the judge if he is minded to grant it.

JR objects to the application.
Judge reads out the order - it says what it says. Are you seeking to vary the order?
JR I may be able to clear up some of the mysteries...

ickky · 07/02/2025 12:44

JR will clear up some of the mysteries.....

katmarie · 07/02/2025 12:44

The judge doesn't seem to be impressed.

Madcats · 07/02/2025 12:44

Meanwhile on R4 (I guess it started at 12:30) Antisocial is hosting a surrogacy spat.

Skyellaskerry · 07/02/2025 12:44

Out of general interest, does anyone know whether witnesses can be subpoenaed in this sort of hearing in Scotland?

Mmmnotsure · 07/02/2025 12:45

It as though there is, suddenly, an adult in the room. Talking about adult, real stuff. The ramifications of the actions of NHS Fife and Dr U in reality and legality.

We are a long way from the I'm special and it's all about meee show of yesterday.

Dr U has been sitting there with nowhere to go. I wonder to what extent he understands about what is happening here and the potential danger he has put himself in. (That's of course if it pans out as one hopes from now on...)

Interestingly Jane Russell talks to the judge like he's six years old, as well.

katmarie · 07/02/2025 12:45

ickky · 07/02/2025 12:44

JR will clear up some of the mysteries.....

That feels unlikely...

ArabellaScott · 07/02/2025 12:45

'JR - my instructions were that the only person the 2nd respondent had sent doc to were her solicitors and the BMA'
'They had the BMA docs yesterday'
'My opponent has decided that that's not good enough ad sees something behidn it that in my submission is not there'
