NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #5

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 January 2025 and is expected to continue for 2 weeks. The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton started giving evidence on 6 February.

So, my understanding of this, and this is only my own understanding, is that somehow between the first and second investigations, the complaint changed/expanded to include the concerns around patient care. Add to that, there has been a total failure to disclose the documents related to the first invstigation, why it was ended, and how the second investigator was appointed.

As a result it's not clear why SP was suspended, kept on suspension, and what the NHS was investigating for so long.

Do I have that right?

She will want the tribunal to conclude that the respondents are trying to hide evidence that shows beyond any doubt that they failed to follow the correct process and did not have any reasonable justification for their actions.

Yes, but we need a ruling on this so single sex spaces can be implemented.

You may still get that ruling even if the tribunal agree that the respondents are hiding evidence because it damages their case.

It’s outrageous that his piddly nothing complaints about “risks to patient care” caused Sandie to be informed she’d need to have her practice supervised, and someone to supervise her interactions with patients and colleagues.
She’s not the one that needs their interactions supervising.

This is similar to the 'gross misconduct or not' in Rox Adam's case, isn't it.

Have I understood correctly that someone investigating the complaint recommended that the suspension was lifted and that it was made clear to everyone that the changing room was female only?

And then that investigation was aborted and this is only coming out now???
