NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #5

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 January 2025 and is expected to continue for 2 weeks. The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton started giving evidence on 6 February.

Yes it really is. And I still think SP or anyone put in the same position should counter action somehow on those that do it

I’m guessing but looking at their faces, he looks like them.

So, my understanding of this, and this is only my own understanding, is that somehow between the first and second investigations, the complaint changed/expanded to include the concerns around patient care. Add to that, there has been a total failure to disclose the documents related to the first invstigation, why it was ended, and how the second investigator was appointed.

As a result it's not clear why SP was suspended, kept on suspension, and what the NHS was investigating for so long.

Do I have that right?

Sounds like both NHS Fife and Dr U have both not only not produced the material, but have taken steps to conceal it.

You may still get that ruling even if the tribunal agree that the respondents are hiding evidence because it damages their case.

This is really going to sway the panel as to which side is being truthful and which side is hiding and lying about shit. What the fuck were NHS Fife thinking?

It’s outrageous that his piddly nothing complaints about “risks to patient care” caused Sandie to be informed she’d need to have her practice supervised, and someone to supervise her interactions with patients and colleagues.
She’s not the one that needs their interactions supervising.

I'm nervous. What's the best outcome Sandie can hope for and how likely is this to happen? I'm tired of this situation but I know this is just the beginning for women.

Might be a bit dry and procedural for Reporting Scotland - unless Dr U faints or something else ‘dramatic’ happens…

This is similar to the 'gross misconduct or not' in Rox Adam's case, isn't it.

Have I understood correctly that someone investigating the complaint recommended that the suspension was lifted and that it was made clear to everyone that the changing room was female only?

And then that investigation was aborted and this is only coming out now???
