NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #4

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 January 2025 and is expected to continue for 2 weeks.

Access to view the hearing remotely can be obtained by sending an email request to [email protected] headed Public Access Request (Peggie v Fife Health Board) 4104864/2024 and requesting access.

FFS I'm 30 years in medicine now and if I made a note in my phone every time someone looked at me funny or didn't do what I asked I'd have lasted 5 minutes.

The fundamental rule of survival in the NHS as a female doctor is be nice to the nurses at all times.

Dr Upton was going out of his way to look for trouble.

All of this, all of it, is an attempt by Upton to establish himself as a victim of workplace bullying.

It could perhaps be inferred from the note taking that he was actively looking for anything that could possibly be labelled as such.

I find the level of gaslighting quite difficult to deal with as someone with personal experience of this type of abuse. Of course women see a man.

Yes, it's coercive control. Which is illegal in a personal relationship and bloody should be in a doctor patient relationship too.

I have worked in many hospitals for many years. There are a million difficult interactions every single day. People are rude, dismissive, make assumptions, don't use please and thank you and are short or short or tearful under stress and pressure. I have literally never ever made little immediate notes about people ever.

I have of course had to write retrospective long hand statements before in light of complaints or poor outcomes but jotting down my thoughts and feelings in others' behaviours in real time. Never.

Can I just ask why Dr Upton gets 5 supporters behind him and Sandie Peggie had zero?

If I'd have known it was an option, i'd happily have been there to support women's basic rights.

Is it differential treatment based on sex?

Now talking about the 2nd CR encounter? He entered with a female colleague and was chatting/started to get changed to start a day shift. Didn't know when female colleague left. Dr U changed and left. Possibly said hello to SP then not seen her leave. SP didn't say hello or acknowledge as Dr U left. The discussion is referring to 2 different events so it is difficult to keep track. No physical or sexual contact between the SP and Dr U. "It's happened twice. It has gone beyond a single incident. I need to make a note of it and inform someone more senior than me in case it escalates. It is not nice when someone feels threatened by you... when you haven't done anything to suggest that you are a threatening person. If it was just going to stay at this level then OK it doesn't feel nice but if that is how she is dealing with it then [not to take it further]"

I've just seen the link about Sandie's dad sadly passing away at the beginning of January. That was his last Christmas. I imagine he might have been poorly, and everyone in the family was trying their best to keep it together and make it a nice time. I've no words right now about that despicable line of questioning from JR.

No, that was Christmas 2023 I think, so wouldn't have been his last Christmas.
