Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 January 2025 and is expected to continue for 2 weeks.

Access to view the hearing remotely can be obtained by sending an email request to [email protected] headed Public Access Request (Peggie v Fife Health Board) 4104864/2024 and requesting access.

I consider the use of the term 'man' derogatory in the context of a transwoman.

TWETMIRF · 06/02/2025 15:17

He's not respecting her protected characteristics either

I think, if he had a GRC now, his birth would be registered at ScotlandsPeople as Elizabeth, F, rather than as Theodore, M? Or is changing your birth certificate something people with GRCs can do but need not?

ThatPithySheep · 06/02/2025 15:17

She doesn't have to accept your belief about yourself you absolute numpty

Madcats · 06/02/2025 15:18

Nope. No hormones. Nothing. Apart from deciding he is a woman. Haldane judgment means he should be treated as a man of the male sex.

We're not getting to NC today, are we? Pity.

Appalonia · 06/02/2025 15:19

This is literally about silencing women for asserting their legal rights, isn't it?

Doubt it.

We decided we should complete a 'datex' (?) as a hate incident. Dr Searle did it in my presence.

SP's behaviour, he says she:

Denied my identity.
Clearly demonstrative of that non-acceptance.

Who has taught him all these phrases that roll off the tw tongue?

ThatPithySheep · 06/02/2025 15:19

Dr Serell wrote the complaint but wasn't actually there so is only taking his views

AnnaMagnani · 06/02/2025 15:20

Had to go and do some actual work, just got back and can't believe what I am reading.

My experience as a female junior doctor, with severe depression, is so light years away from the absolute bending over backwards this useless man has had I don't know where to begin.

Fuming doesn't even begin to cover it.

Datix I think

It's a reporting system for complaints and incidents

Boiledbeetle · 06/02/2025 15:22

This was apparently the first time someone had burst his imaginary bubble and let reality slip back in.

Much swearing at the screen by all us watching

sounds fair, it's building in me now I am watching. I will swear soon in solidarity I am sure

Boiledbeetle · 06/02/2025 15:22

HR, GP and counselling

AnnaMagnani · 06/02/2025 15:23

I did a Datix once to point out that someone's reed diffuser has made me go off sick with an asthma attack.

Got told it was too hard to get the person to remove the diffuser and then criticised for having too much sickness.

I was a fucking Consultant and head of department at the time.

ThatPithySheep · 06/02/2025 15:23

OH????? for being told reality. When women can't get help for menopause, menstrual pain etc. at work

CriticalCondition · 06/02/2025 15:23

We discussed I would send in a separate formal complaint and I would speak to occupational health, speak to my GP and seek private counselling to help me deal with what had happened.

Appalonia · 06/02/2025 15:23

He was referred to OC, go to his G P & get counselling to work through what had happened.

He said he is a woman didn’t he? When questioned by JR about his special identity.

He certainly isn't treated like one...seems the NHS likes telling women who express their discomfort about changing rooms to piss off and get in a cupboard, but get out the kids gloves, take it super seriously and do everything they can when the ''woman'' expressing discomfort is a male.

Weird how they're not at all bothered or invalidated by retaining this obvious male privilege despite being a laydee, isn't it?

Endthisshit · 06/02/2025 15:24

Why oh why are the NHS employing a doctor who is so fragile that he needs counselling! More of our tax £££££ all to tell a bloke he’s not welcome in the ladies! OFFS
