NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #4

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 January 2025 and is expected to continue for 2 weeks.

Access to view the hearing remotely can be obtained by sending an email request to [email protected] headed Public Access Request (Peggie v Fife Health Board) 4104864/2024 and requesting access.

After the conversation, he went to find the consultant on duty.

Then had a conversation with consultant. In the wellbeing room.

So that's a consultant taken away from providing patient care in order to deal with him.

That's not what is happening, though. This isn't about whether he should have been in the female changing room.

It's about whether SP's complaints about him using the female changing room were bullying and whether the NHS was right to suspend her for them.

Yes, but if it wouldn't have been bullying if he was a non-TW male, and if we accept her view that he's male (which the court has), then that's relevant to this case - or should be.

Do we know what the seating arrangements are off camera? Is there space elsewhere in the room? We can only see the panel, the witness stand and the front row of lawyers.

The five person support team are in prime position top and centre of the shot. It's not just a performance for the judge, it's a performance put on for everyone watching over video.

I don't think it does anything to enhance a witness's credibility - the opposite if anything...

Hang on, here her 'eye contact' is angry but BEFORE he said the 'lack of eye contact' and direct address was harassment.

It's so OBVIOUSLY coercive control. She can never win, too much eye contact = bad, none = also bad. Bad woman burn the witch. He's abusing her with apparently the enthusiastic participation of NHS fife.

I've not tuned in, but did he say he was autistic or was that mumsnet speculation?

If he is autistic, surely direct communication is a reasonable adjustment to disability. You can't then complain people are speaking directly.

Reading your comments I get the impression he thinks this will all be over as soon as the judge realises he was really really sad about it. And I’m used to being sad, because I am a poor weak woman regularly abused by men, and this made me EVEN MORE SAD!
