NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #4

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 January 2025 and is expected to continue for 2 weeks.

So upset he immediately made notes on his phone? Aware I'm not all people but if I was really upset I wouldn't even think to do that in the moment.

Yes. When asked very specifically what she said, BU reported SP as saying 'it's like the situation in the prisons'.

And he said he took that to mean she meant Bryson.

Which is some leap.

Would SP be allowed to feel intimidated, alarmed, uncomfortable or upset about any other (non trans ID-ing) male coming into the women's changing room and undressing/seeing her undressed? I guess so or else they wouldn't have separate sexed rooms.

So this is about whether we accept that SP does not have to perceive BU as a woman - something that has already been accepted in this case. And this rests on the fact that BU is male, not female.

To win this case the onus should be on BU/BU's lawyers to prove he is female. If they can't do that there is no case. IMO but IANAL.

That's not what is happening, though. This isn't about whether he should have been in the female changing room.

It's about whether SP's complaints about him using the female changing room were bullying and whether the NHS was right to suspend her for them.

That he can say he felt unsafe because someone didn't like him changing in the female CR, to any woman, shows he has no CLUE what being a woman is like.

Women know who is the more unsafe in that situation. Men who care listen to women about this.
