NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #4

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 January 2025 and is expected to continue for 2 weeks.

The whole thing is absolutely ridiculous. Scottish Government, NHS Scotland and Fife should be absolutely ashamed of themselves for letting it all come to this. Health and Social Care in Scotland are an absolute shambles and yet this shite is where the time, energy and money is directed.

From what I've seen of trans-identifying influencers and online forums frequented by trans-identifying people, there very much is a script that - mainly teenagers but also young adults - are encouraged into parroting once their 'egg is cracked'. And what behaviours others must do (ie nothing less than enthusastic affirmation) in order to make them feel safe, and if others do not go along with these, they are hateful and 'unsafe' to be around. I do feel very sorry for those who have been influenced in such a way when vulnerable and then enabled but that's as far as my sympathy goes.

Would SP be allowed to feel intimidated, alarmed, uncomfortable or upset about any other (non trans ID-ing) male coming into the women's changing room and undressing/seeing her undressed? I guess so or else they wouldn't have separate sexed rooms.

So this is about whether we accept that SP does not have to perceive BU as a woman - something that has already been accepted in this case. And this rests on the fact that BU is male, not female.

To win this case the onus should be on BU/BU's lawyers to prove he is female. If they can't do that there is no case. IMO but IANAL.

A very poor reflection on the NHS that no one has stepped in and said to DU that he may not be fit to practise and it would be advisable to get some help.
