NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #4

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 January 2025 and is expected to continue for 2 weeks.

Access to view the hearing remotely can be obtained by sending an email request to [email protected] headed Public Access Request (Peggie v Fife Health Board) 4104864/2024 and requesting access.

I think you’re right. It is rather they want to intimidate. A posse. Also, when NC is questioning (if DU doesn’t abscond to try to avoid having to deal with anything which doesn’t massage his ego and claims), she will be facing a wall of hostile people. Not just the 2nd Respondent. I think it is to cow people.

Even more than before, I think SP is very courageous to have not been cowed by this man and the management of NHS Fife attempts to inflict an abusive situation upon her, and then to persecute her as hateful for not letting them force her to ‘willingly’ be abused. I think she is a role model.

I think you're right but I also think if they think this will 'cow' NC then they really haven't done any background research on NC. 😂

However, the bullying behaviour seems to be standard practice from what we're hearing.

Over lunch I've been trying to get my head round the fact that Dr U's manager/supervisor, the BMA, HR, the Finance Officer, the lawyer, the KC didn't suggest that this was not going to look good and they should aim to settle.

How on earth did "upset because she wouldn't change with me" and "told me she was uncomfortable" end up with her being suspended for best part of a year?

DD was considering a medicine-related career - thank goodness she didn't enjoy her week of work experience at the local hospital!

But she walked out because she didn't want to be in the women's changing room with a man. So saying she was doing it to give him privacy would be disingenuous. And also accepting that it was ok for him to be in there. Which it wasn't.

See when witnesses are not allowed to discuss their evidence, questions, etc with their lawyer or anyone else during the breaks, is that actually monitored at all? Does it mean they have to go for separate sandwiches/talk about the weather? What would happen if someone suspected them of moving from small talk to something that might be substantive? Or is it just a polite fiction and actually they all just go off and game-plan like mad?

The very idea that he has potentially such authority over women and girls in mental health crisis is frightening.

I've watched Naomi Cunningham in action several times in recent years. That woman is focus personified. In a long and distinguished career I'm sure she's seen cheap tactics like this many times. And responds appropriately. By ignoring them.

Long discussion about a child/patient who was seen in triage but left without treatment. SP didn't say hello to Dr U when arriving to discuss this case. But did give information about the patient. Didn't look at or acknowledge Dr U while providing report. SP left the Drs area. Dr U made notes about this interaction "took keep track of them" "when I have these interactions I try to write them as soon as possible as they are fresh in my mind" "I wanted to make sure I had a record of these incidents as it was unusual" "I was concious that unfortunately I am aware that there are people who object to the existence of trans people and I am vulnerable to that sort of tension" "I wanted to be able to say in the future about what had happened so there was an accurate understanding"
