NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #4

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 January 2025 and is expected to continue for 2 weeks.

Access to view the hearing remotely can be obtained by sending an email request to [email protected] headed Public Access Request (Peggie v Fife Health Board) 4104864/2024 and requesting access.

On the 5 observers (+1 who had to sit elsewhere) why are they allowed behind the witness box without having to identify themselves? Observers sit outside the proceedings but they are "on stage" as it were. Anyone know?

And other stuff - to be investigated in further questioning. So far there is nothing I can see to support harrassment of anyone. It is all very weird

I've had a consultant wheel me on my bed to a CT scan as there wasn't anyone else available and time was of the essence. If he'd insisted it wasn't his job and waited for a porter I'd be dead right now.

The pain med doctor for the Ortho Ward at the Vic wheeled me out in my wheelchair when there were no porters available.

Do we know what the seating arrangements are off camera? Is there space elsewhere in the room? We can only see the panel, the witness stand and the front row of lawyers.

The five person support team are in prime position top and centre of the shot. It's not just a performance for the judge, it's a performance put on for everyone watching over video.

I think you’re right. It is rather they want to intimidate. A posse. Also, when NC is questioning (if DU doesn’t abscond to try to avoid having to deal with anything which doesn’t massage his ego and claims), she will be facing a wall of hostile people. Not just the 2nd Respondent. I think it is to cow people.

Even more than before, I think SP is very courageous to have not been cowed by this man and the management of NHS Fife attempts to inflict an abusive situation upon her, and then to persecute her as hateful for not letting them force her to ‘willingly’ be abused. I think she is a role model.

You've got to wonder at what point a woman is allowed to say 'no'.

If she goes into a toilet cubicle to change, is that bullying? If she waits until he leaves to get undressed, is that bullying? If she asks him not to take out his phone to make 'notes' in the changing room, would that be bullying? If she wears two layers of clothing so he can't see her undressed, because of her religion, is that bullying?

To what extent is he allowed to use women staff? What's the boundary? Do they actually have to strip naked in front of him regardless of their personal feelings, religion, disability, for him to be satisfied there's no 'bullying' because it seems that NHS Fife is very much trying to give this man whatever cutted up pear he wants. No matter how many women it tramples over.

I am seriously considering requesting the link to join. I work in HR and as a member of Seen in HR am following this closely.

As well as being an Adult Human Female, who was sexually assaulted by a man (who to my knowledge identified as such) in the women’s toilets, and continues to suffer with PTSD, made significantly more manageable by several years of therapy. I can confirm that I would and have, turned around and left female only facilities because a male has been in there (most notably, motorway service station toilets with male cleaning staff). There is nothing in this world that would allow me to share that changing room with DU, and it’s a hill I would be willing to die on.

I simply cannot understand how the ‘rights’ of DU to have others ‘be kind’, validate their existence and not be made ‘sad’, override others rights in terms of disability (which is what my ptsd is in legal terms), sex, or belief- including religion and GC.

I requested the link earlier today and they replied within 20 minutes with the link

@Shortshriftandlethal maybe I didn’t explain myself well. DU is claiming SP on two occasions walked in and then walked out and waited = harassment. SP could argue, walked in someone changing so walked out to give them privacy.
