NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board - thread #2

1000 replies

nauticant · 04/02/2025 11:37

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 January 2025 and is expected to continue for 2 weeks.

The idea that women will feel uncomfortable changing in a room with a man is so normal, I can't believe we even have to say it out loud.

Exactly. Why do they think we have separate facilities in the first place?

Why are the feelings of some men who don't wish to change with other men valid and reasonable, and those men must be immediately pandered to, but a woman who doesn't want to change in front of a man is unreasonable, a terf, a bully, a liar, a harasser, a transphobe, using the wrong 'tone', etc?

Sorry for the late response - only just catching up on this thread. Leading questions are allowed in cross examination but not in direct examination. So JR cannot ask any leading questions of DU, for example, but she can ask as many leading questions of SP as she wants..

Thanks

Why don't they only let people in who've chosen 'observer'? Why are they letting people in who've chosen any of the other options?

I don't think the clerk can see what option people have picked. The system isn't that sophisticated.

Sorry if this has been asked, I'm behind in the thread by several pages - I've just tried for the first time to join (work forbidding up to now) using a link supplied last week by Edinburgh, and I've been able to enter the pin and pick Observer, but I just get a silent screen with a white background, a coat of arms and a fuzzy blue box which looks as though if I could read it it would have the warning that it's a criminal offence to broadcast etc. Does this seem like something that is expected so that I should just stay here, or is it a sign that I need to ask for a new link from Dundee, or what? Anyone know?

Yes it sounds like you’re in the waiting room.

fanOfBen · 04/02/2025 15:01

I refreshed and now I see other names in the sidebar, so at least I'm not alone, maybe this is the waiting room.

That's what I got as Observer fanOfBen. It wouldn't even give me the automated audio message about waiting to join. I do get access if I select video and audio and then make sure both are disabled.

The software the courts use is the issue. At the very least the court should be able to broadcast as a webinar with no participation from the online audience. If that is not possible the clerk should be able to mute all, and turn the cameras off. So frustrating.

Boiledbeetle · 04/02/2025 15:03

JR has moved on to a note by Charlotte miles

JR says SP said there was two issues with meeting, missed what they were though.

Yes, that happened to me as well. Am on an iPad - what are you using?

Can you hear a voice saying “waiting for host to join”

Change your browser. That's how it appears on Firefox and I don't get the WFTCHTJ. The software doesn't appear compatible with all browsers.

It works for me on Edge and Chrome.

nauticant · 04/02/2025 15:04

I'm on a Windows laptop chilling19.

You shouldn't be able to see other people's names if you're not in the hearing.

I can't find any option to mute myself

Scroll down to bottom of screen when you see the courtroom. Click on left-hand icons to mute microphone and turn off camera.

I can't remember how to mute before you get to that stage.

ChimpanzeeThatMonkeyNews · 04/02/2025 15:06

If you join as Observer, your camera and mic are automatically switched off

These options don't appear for me as an observer.

seXX · 04/02/2025 15:06

how long as SP suspended for? When did she return to work?

legalimmigrant · 04/02/2025 15:06

Justabaker · 04/02/2025 14:55

URGENT

Poor compliance from remote observers is looking like it might end remote access for all observers. Please can everyone turn off cameras and microphones on joining the conference.

@Justabaker It's not women who believe in biological reality doing this. It's a very clear and obvious attempt to prevent open justice. Many of us have discussed how we've gone to great lengths to ensure we can't be seen or heard.

It would be really very easy for the court to ensure only those who choose the 'observer' option where camera and mic are automatically muted are allowed in. So this is a deliberate attempt to restrict women knowing the truth and the court is enabling it by their shit IT.

Nor me

fanOfBen · 04/02/2025 15:07

I couldn't make it work as observer - now in successfully video+audio, with camera and audio off. I hope!

legalimmigrant · 04/02/2025 15:08

It's ridiculous we're given any option other than Observer. It's so unbelievably piss poor. The courts need to get into the 20th century (I know we're in the 21st, but I'm being realistic).

Rightsraptor · 04/02/2025 15:08

I'm wondering if Dundee employment tribunal court aren't used to having so many, or even any, observers and so the court staff are on a bit of a sharp learning curve. Like how to mute us all.

Boiledbeetle · 04/02/2025 15:09

I may have got this wrong as sound keeps dropping out

JR trying to make the Fife solutions of working days/somewhere else as being totally reasonable, ignoring the fact that SP had worked nights for ever and the other place was unsuitable

Rightsraptor · 04/02/2025 15:10

The other role was unsuitable for Sandie, given that she's not qualified to undertake it.

the clerk is S Moriarty, a name I've seen before.
