NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board - thread #2

nauticant · 04/02/2025 11:37

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 January 2025 and is expected to continue for 2 weeks.

And booted out again

nauticant · 04/02/2025 14:31

Yes, I'm worried we might end up with no observers allowed.

Me too Posh Coffee.

I'll stick around for a while though, I need to be here in the thick of it.

Has someone been doing something bad maybe?

Oh gawd, what’s happening now? I’ve been disconnected again just after the man cleared his throat and sniffed very loudly

how could you possibly tell that was a man? You must be a witch! Wink

ChimpanzeeThatMonkeyNews · 04/02/2025 14:32

I'm guessing that the Judge's patience is going to be wearing very thin.

To be fair, I don't blame him.

Another thing I’d be very concerned about is any biological male using their phones (presumably with cameras) in a supposed single sex female changing room.

That is in general, not a remark about this specific case.

That's a very good point.

I personally would find it very oppressive to have a random man (who was not my family) undressing in an enclosed supposedly space with only me and him in the room. I would be on such high alert all the time, it would be exhausting. Also, you’d have to be fidgeting underneath a bath towel yourself so there would be no voyeuristic possibilities for any males in such a space. It is the complete lack of consent for women, and the full entitlement of males enforced from on high.

I wonder if men now think they have a right to lodge complaints of bullying about women who won’t stay while the chaps are undressing, or women who don’t wish to be in a state of undress in front of a male. The bold woman refused,

This. If I had to share changing space with a man and pretend he was a woman I would feel uncomfortable around him in general. I would also feel a level of frustration and resentment towards that person and would find it difficult to maintain a normal working relationship with him. There is an abuse going on here and I'm not quite sure that SP is quite able to articulate it. This is not her fault but it's very frustrating to see her being painted as the bigot and Dr Upton as some vulnerable down trodden victim.

Back in. It's like doing the hokey cokey

Ereshkigalangcleg · 04/02/2025 14:35

I hope Naomi is going to bring this out when she cross examines both Upton and hospital people.

I believe DU could appeal even if the hospital don’t.

Allison Bailey has appealed against one part of her judgement - the decision in favour of Stonewall.

Allison was the claimant, not the respondent

Rightsraptor · 04/02/2025 14:36

Oh God, sniffing, crunching and throat-clearing again

ItsAllGoingToBeFine · 04/02/2025 14:37

But it's in the tribunal I think?

PoshCoffee · 04/02/2025 14:37

FFS. Who hasn’t turned off their mic?

Iain fucking Wilson again, why not just kick him out.

I googled to find more info on this case - Pink News is very upset that Dr Upton can be "misgendered" in the hearing, but interestingly the comment section was open but empty.

The case is covered by HRmagazing.com, which did recognise that women may not want to change with men but included the following from a TRA:

"Allegra Chapman, co-founder of diversity and inclusion consultancy Watch this Sp_ce, added that HR may be contending with workplace pronoun disputes which are influenced by forces outside of their control.
She told HR magazine: “Hostility towards trans people occurs due to fear and lack of understanding, which has sadly been stoked and encouraged by the media.”"

I find it bizzare that TRAs are still claiming women objecting to sharing spaces with men is because of "fear and lack of understanding". Yes of course there is fear, of male violence and voyeurism, but there is definately understanding. Re-education is not going to make me accept that any biological male can become a woman.

ChimpanzeeThatMonkeyNews · 04/02/2025 14:38

The same man who was fiddling with his phone.

It's the guy who had his head in shot earlier. The chat box is busy!

Datun · 04/02/2025 14:38

The idea that women will feel uncomfortable changing in a room with a man is so normal, I can't believe we even have to say it out loud.

Who the fuck wants to take their clothes off in front of a man? Even your own family can be discomforting. Fathers-in-law, brothers, your son's friends, etc.

It's completely normal to expect some privacy when you're taking your clothes off.

You can just about put up with other women, because of everything that you have in common with them.

But men, not a fucking chance.

I hope the panel are either so clued up as to know exactly what's happening and won't fall for be kind, or hopelessly unclued up and be outraged.

Happyhippos123 · 04/02/2025 14:39

And thanks everyone who is providing the commentary on the tribunal.
