NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board - thread #2

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 January 2025 and is expected to continue for 2 weeks.

I find it ironic that JR is going on so much about SP not using female pronouns for a male. When JR refers to Upton as ‘he’ a few times herself. I hope NC calls her out on not reaching the standards of using incorrect sex pronouns she is admonishing others for. No greater crime really, it seems, so maybe JR should willingly go into the dock.

Also do women now have to offer themselves up to be victims if a male wants to transgress women’s boundaries? I think that there used to be campaigns for women to keep alert. Trust your instinct sort of thing. After this, I’d personally be very much avoiding men who behaved like this. Of course, SP could not do that as she had no real options to protect her dignity, privacy or even potential safety. That is why men usually are kept (and keep) out of women’s intimate spaces. I suppose some men have found (and been given carte blanch with it) a loophole that lets them ignore what any decent man would do (in my opinion). They have it all wrapped up. Everyone knows they are men, so their writing of diary entries that may be twisted fictional bunkum, will be taken as Gospel by authorities. Also, knowing he was distressing her, the bit about almost wanting to have her forced to kow-tow to him by her forced presence, and eye contact. I think it is quite nasty really. Knowing some men can escalate their transgressive behaviour.

It seems to me it's not even whether a woman has a right to a single sex space, it's whether she has the right to not share a belief that a man has about himself (that he's a woman, see pronouns), or even to dislike him or feel wary of him.

The impression I get from reading the threads is that she is accused of 'not making eye contact', 'using the wrong pronouns' and not going into a changing room while he's in it.

So it's not just about her right to a single sex space, but her right to believe that a man is a man whatever pronouns he uses, and her right to avoid a man who makes her uncomfortable. Her right to her own beliefs, preferences, and feelings.

I could be picking it up wrong as I can't watch it live, unfortunately.

I haven’t been following closely, have I missed an update about whether Dr Upton’s previous record under a different name could be considered? The judge had gone away to read up, I think.
I saw reference to it but can’t find an answer.

I googled to find more info on this case - Pink News is very upset that Dr Upton can be "misgendered" in the hearing, but interestingly the comment section was open but empty.

The case is covered by HRmagazing.com, which did recognise that women may not want to change with men but included the following from a TRA:

"Allegra Chapman, co-founder of diversity and inclusion consultancy Watch this Sp­_ce, added that HR may be contending with workplace pronoun disputes which are influenced by forces outside of their control.
She told HR magazine: “Hostility towards trans people occurs due to fear and lack of understanding, which has sadly been stoked and encouraged by the media.”"

I find it bizzare that TRAs are still claiming women objecting to sharing spaces with men is because of "fear and lack of understanding". Yes of course there is fear, of male violence and voyeurism, but there is definately understanding. Re-education is not going to make me accept that any biological male can become a woman.

It's always frustrating reading what TRAs say. Because the very next question would be what is it we need to understand?

And then you get down to it.

They rely on outrage that you're accusing them of being predatory.

When in fact, they're just as predatory as all other men, and according to prison statistics, more so.

Everyone walks on eggshells, because of the performative outrage, but once you can dispense with that, it's a slam dunk.

edited to add that it's the dispensing of that that's the problem.

None of these cases even float the question of Malaga man, for instance.

Respondents can appeal a judgement in the same way a claimant can.

The idea that women will feel uncomfortable changing in a room with a man is so normal, I can't believe we even have to say it out loud.

Who the fuck wants to take their clothes off in front of a man? Even your own family can be discomforting. Fathers-in-law, brothers, your son's friends, etc.

It's completely normal to expect some privacy when you're taking your clothes off.

You can just about put up with other women, because of everything that you have in common with them.

But men, not a fucking chance.

I hope the panel are either so clued up as to know exactly what's happening and won't fall for be kind, or hopelessly unclued up and be outraged.

There's also the fact that women who have experienced male violence are often left with a crippling and quite understandable terror of men. I grew up with DV, in my late teens my fear of men was overwhelming. And do you know what the biggest problem with men is when you're in that place? They're bloody everywhere. Female only toilets and changing rooms saved me on multiple occasions when I was close to having a panic attack in public. Now we're being told that female only spaces are for women plus any man who wants to use them?

No. Just no.

And because of that, Dr Upton was signed off with stress for two months. What happens if his patient dies? What happens if a patient disagrees with him?
