nauticant · 04/02/2025 11:37

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 January 2025 and is expected to continue for 2 weeks.

The Judge is very tardy.

Tbf if my camera was on it'd probably look incriminating. Tribunal on laptop with me on my phone in front. I'm not taking pictures on the screen but rather enjoying the vipers nest.

Boiledbeetle · 04/02/2025 13:56

Judge arriving now

ILikeDungs · 04/02/2025 13:57

No sound

Mine is taped over to avoid incidents of accidental outing!

I don't think so, the camera was parallel to the screen

Boiledbeetle · 04/02/2025 13:58

SP didn't believe on her part she had been bullying

Boiledbeetle · 04/02/2025 13:58

Don't know what the question was!

Beth strikes me as utterly lacking in the resilience necessary to be a functioning doctor.

Or TBH a functioning adult.

Which is why it might be quite interesting if he is cross examined by Cunningham.

Is he going to start crying and find that his resilience is on the floor, or is he going to get angry and entitled?

Boiledbeetle · 04/02/2025 14:00

JR: Looked at bullying and harrassment policy before lunch.

😂Me too. I have the switch thingy for the camera off. I've turned camera and microphone access off in settings AND I have a plaster over the camera.

After watching SP being questioned why would any woman not want to avoid that? Process is the punishment indeed.

SP is a modern day suffragette IMO. What a brave, brave woman.

Boiledbeetle · 04/02/2025 14:01

JR onto guide to suspension ? I think?

Boiledbeetle · 04/02/2025 14:02

Judge: it's a conduct policy is that right?
JR: yes

I'm imagining a huge amount of interventions from JR and calls for breaks if BU does appear.

Boiledbeetle · 04/02/2025 14:03

JR on about suspension letter being within four calendar days of the suspension.

Datun · 04/02/2025 14:04

I hope Dr Upton is asked if he starts crying and gets upset if a patient misgenders him.

Boiledbeetle · 04/02/2025 14:05

Not sure where this current line of questioning is going 're suspension

It's my understanding that a lot of these tribunals succeed or fail on all the correct processes being followed, and the admin being nailed down.

It would be a shame if the bloody elephant in the room is ignored once again

Madcats · 04/02/2025 14:06

Boiled NHS Fife need to demonstrate that they followed their policy. I doubt it says ...then faff about for a year leaving a nurse in limbo, but maybe it does

Ahh, so JR is getting confirmation of correctly following suspension procedure from SP

Boiledbeetle · 04/02/2025 14:09

Onto suspension risk assessment. SP not aware they'd done that for her.

Datun · 04/02/2025 14:09

If they find Sandie is discriminated against because they fucked up the process (which is so common I almost can't believe it) does that mean she wins the case, but he gets to stay in the changing room?

Until she complains again, and this time they carefully follow the right procedure, and he still gets to stay

@nauticant well said. I would hate for TT or the remote access to be withdrawn because of inappropriate comments on this thread.

Is there anything specific we should avoid commenting on? Considering the defence consider misgendering and calling BU a man is grossly offensive I imagine they would take issue with the entire thread.

Boiledbeetle · 04/02/2025 14:10

JR stating they were taking a neutral stance...

Judge leaves after a woman's head appears on the feed.

ChimpanzeeThatMonkeyNews · 04/02/2025 14:10

Judge is peeved about an observer who had their camera on.
