NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board - thread #2

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 January 2025 and is expected to continue for 2 weeks.

Is there anything specific we should avoid commenting on? Considering the defence consider misgendering and calling BU a man is grossly offensive I imagine they would take issue with the entire thread.

JR can say what she likes, the judge has said the two sides can use whatever pronouns they like.

Both SP and DU are employees and were both representing their employer at the time of the incident (s) and complaints.

The issue is should the hospital have provided true single sex spaces for their employees. Should they have taken SPs initial enquiries/complaints seriously.

The hospital effectively has to show they did not discriminate against either SP or DU. The obvious answer was a third space. This respects sex and gender reassignment by providing appropriate changing rooms that respect female and transgender employees right to privacy and treated them both with dignity and respect.

There is real outrage that SP has named DU as the second respondent. It’s actually a clever move.

Remember DU could potentially have taken a case to ET naming the hospital and SP but as far as I’m aware didn’t.

This is a first tribunal, so it won't set precedent. If Ms Peggie wins, NHS Fife are unlikely to appeal. But Dr Upton might want to. Would being second respondant allow him to (I think the term is "has standing")? Because Dr Upton appealing and losing would set precedent.

Until she complains again, and this time they carefully follow the right procedure, and he still gets to stay

Perhaps. What we really need is a judgment that rules it to be discriminatory not to provide women with a single sex changing room. Then the policy would need to change.

As I entered the virtual session as "observer" I haven't had the option to turn camera and mic on/off. Should I?

There should be a panel at the bottom of the screen where you can check your sound/ camera is off.

They really should give instructions to people remotely viewing, and what each option means when you select who you are.

In early cases, you had to join with video and audio, or you couldn't see or hear the tribunal, which was stupid. It's great they've added an 'observer' option, but people need to be told to use it.

The observer option doesn't allow the camera or mic to be used. Those joining with video and audio are causing the issues.

And as I've listened in to a work webinar and boiled a kettle and sorted the washing etc without anyone flagging me as an issue I think it must be fine :D

I do like joining with video and audio so that I can check myself the status of the microphone and the camera and confirm they're both off.

Doesn't it pop up when you move your mouse across the screen?

You aren't showing up on the screen and there's no background noise atm so I think you're probably fine.

I didn't get that functionality when I joined as an observer. This was on a laptop.

Also JR appears (to my uneducated ear) to be asking lots of leading questions.

JR is cross examining. Leading questions is standard. You can't ask leading questions in examination-in-chief or re-examination (which is of your own witnesses). So Ms Russell can ask SP leading questions all day long, Ms Cunningham can't ask SP any.

Presumably it depends on what options you select when joining etc. I join as a guest and then "allow" everything and then turn my own camera and sound off in the WCHJ window.

In the settings before joining, I have no option for cameras at all. It does ask if I want to mute my audio before joining.

When connected I have no options in regards to camera or mic.

For me it only appears if I hover over the bottom of the screen - it is possible they have been tweaking the way it works though given the issues

I assume this was the same for everyone, but I did notice that when I received access from Edinburgh, it didn't have any attachments detailing log-in, expected behaviour etc that I've had when observing ETs etc. before.

It did cross my mind that new observers might be left to figure out procedure on the fly...
